社會(hui)信用制度是市場(chang)經濟基礎制度。

為健全社會(hui)信用體系(xi)(xi),中(zhong)(zhong)共中(zhong)(zhong)央辦公廳、國務院(yuan)辦公廳近日印發《關于健全社會(hui)信用體系(xi)(xi)的意見》。

意(yi)見部署了23項政策舉(ju)措,涉及(ji)構(gou)建覆蓋各類主體的社會(hui)信(xin)用(yong)體系(xi),夯實社會(hui)信(xin)用(yong)體系(xi)數據基(ji)礎,健(jian)全守信(xin)激(ji)勵(li)和失信(xin)懲戒機制(zhi),健(jian)全以(yi)信(xin)用(yong)為基(ji)礎的監管(guan)和治(zhi)理(li)機制(zhi),提(ti)高社會(hui)信(xin)用(yong)體系(xi)市場化(hua)(hua)社會(hui)化(hua)(hua)水平等5個方面。

意見指出(chu),構建覆蓋各(ge)類主(zhu)體(ti)、制度(du)(du)規(gui)則統(tong)一、共建共享共用(yong)的社(she)會(hui)(hui)信(xin)用(yong)體(ti)系(xi),推(tui)動(dong)社(she)會(hui)(hui)信(xin)用(yong)體(ti)系(xi)與經(jing)濟社(she)會(hui)(hui)發(fa)展(zhan)各(ge)方面各(ge)環節(jie)深(shen)度(du)(du)融(rong)合,為加快建設全國統(tong)一大市場、維護(hu)公平有(you)序(xu)競爭市場秩序(xu)、推(tui)動(dong)高(gao)質量發(fa)展(zhan)提供有(you)力支撐。

社會信(xin)用(yong)制(zhi)度(du)是市場經濟(ji)基礎制(zhi)度(du)。為健全社會信(xin)用(yong)體系,經黨中央、國務院同(tong)意(yi)(yi),現(xian)提(ti)出如下(xia)意(yi)(yi)見。

一、總體要求

堅(jian)(jian)(jian)持(chi)以習近平(ping)新時代中(zhong)國(guo)特(te)色社(she)(she)會主(zhu)義(yi)思(si)想(xiang)為指導,深(shen)入(ru)貫(guan)徹黨的(de)二(er)十大和(he)(he)二(er)十屆二(er)中(zhong)、三中(zhong)全會精神,堅(jian)(jian)(jian)持(chi)和(he)(he)加強(qiang)黨的(de)領導,堅(jian)(jian)(jian)持(chi)穩中(zhong)求進工作總基(ji)調,完整準確全面貫(guan)徹新發展理念(nian),堅(jian)(jian)(jian)持(chi)政府引導、市(shi)場驅動(dong)、社(she)(she)會共建(jian),堅(jian)(jian)(jian)持(chi)弘揚(yang)誠信(xin)(xin)文(wen)化,堅(jian)(jian)(jian)持(chi)公共信(xin)(xin)用(yong)信(xin)(xin)息和(he)(he)市(shi)場信(xin)(xin)用(yong)信(xin)(xin)息相互融(rong)合(he),堅(jian)(jian)(jian)持(chi)信(xin)(xin)用(yong)獎(jiang)懲合(he)理合(he)法,構建(jian)覆蓋(gai)各類主(zhu)體(ti)、制度規則(ze)統(tong)一、共建(jian)共享共用(yong)的(de)社(she)(she)會信(xin)(xin)用(yong)體(ti)系,推動(dong)社(she)(she)會信(xin)(xin)用(yong)體(ti)系與經濟社(she)(she)會發展各方面各環節(jie)深(shen)度融(rong)合(he),為加快建(jian)設全國(guo)統(tong)一大市(shi)場、維護公平(ping)有序競爭(zheng)市(shi)場秩序、推動(dong)高質量(liang)發展提(ti)供有力支撐(cheng)。

二、構建覆(fu)蓋(gai)各類主體的社會信用體系(xi)

(一)深(shen)化(hua)政(zheng)(zheng)(zheng)(zheng)(zheng)務信(xin)(xin)用(yong)(yong)建設。健全政(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)誠(cheng)信(xin)(xin)履(lv)約機制,開展政(zheng)(zheng)(zheng)(zheng)(zheng)務誠(cheng)信(xin)(xin)評(ping)價,完善(shan)政(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)失(shi)信(xin)(xin)行(xing)(xing)為認定(ding)標準和(he)失(shi)信(xin)(xin)懲戒措施,政(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)及其(qi)部門(含下屬單(dan)位(wei))在公共資源交(jiao)易、招商引(yin)資、人才引(yin)進、政(zheng)(zheng)(zheng)(zheng)(zheng)府(fu)與社(she)會資本合作、產業扶持、投資融資、涉企(qi)收費等領域出現失(shi)信(xin)(xin)行(xing)(xing)為的,按(an)規(gui)定(ding)將其(qi)納入(ru)信(xin)(xin)用(yong)(yong)記錄(lu),限制其(qi)申(shen)請各類財政(zheng)(zheng)(zheng)(zheng)(zheng)性資金和(he)項目、試(shi)點示范、評(ping)先評(ping)優。有效發揮(hui)事業單(dan)位(wei)異(yi)常(chang)名錄(lu)作用(yong)(yong),提升(sheng)事業單(dan)位(wei)誠(cheng)信(xin)(xin)自律水平。加強公職人員誠(cheng)信(xin)(xin)管理和(he)教育。

(二)加強經(jing)營(ying)(ying)(ying)主(zhu)體信(xin)(xin)(xin)(xin)用(yong)建設。強化經(jing)營(ying)(ying)(ying)主(zhu)體信(xin)(xin)(xin)(xin)用(yong)管理,支(zhi)持經(jing)營(ying)(ying)(ying)主(zhu)體完善合規經(jing)營(ying)(ying)(ying)制度、管控信(xin)(xin)(xin)(xin)用(yong)風險,引導經(jing)營(ying)(ying)(ying)主(zhu)體誠信(xin)(xin)(xin)(xin)經(jing)營(ying)(ying)(ying)、守信(xin)(xin)(xin)(xin)踐諾。以公共信(xin)(xin)(xin)(xin)用(yong)綜合評價為基礎,建立企(qi)業信(xin)(xin)(xin)(xin)用(yong)狀況(kuang)(kuang)綜合評價體系。在確保(bao)保(bao)密和敏感信(xin)(xin)(xin)(xin)息安(an)全前提(ti)下,加強國有企(qi)業信(xin)(xin)(xin)(xin)用(yong)狀況(kuang)(kuang)披露。鼓(gu)勵經(jing)營(ying)(ying)(ying)主(zhu)體主(zhu)動(dong)向信(xin)(xin)(xin)(xin)用(yong)服(fu)務機(ji)構提(ti)供信(xin)(xin)(xin)(xin)用(yong)信(xin)(xin)(xin)(xin)息,不(bu)斷健全信(xin)(xin)(xin)(xin)用(yong)記錄。

(三(san))加(jia)(jia)快社(she)會(hui)(hui)組織(zhi)(zhi)信(xin)用(yong)(yong)建設。加(jia)(jia)強(qiang)社(she)會(hui)(hui)組織(zhi)(zhi)信(xin)用(yong)(yong)信(xin)息管(guan)理、共(gong)享、公(gong)開(kai),強(qiang)化社(she)會(hui)(hui)組織(zhi)(zhi)信(xin)用(yong)(yong)監管(guan),引導社(she)會(hui)(hui)組織(zhi)(zhi)誠(cheng)信(xin)自律,提(ti)升內部治理水平。行業(ye)主管(guan)部門和業(ye)務(wu)主管(guan)單(dan)位要(yao)推動行業(ye)協(xie)會(hui)(hui)商會(hui)(hui)加(jia)(jia)強(qiang)誠(cheng)信(xin)建設,指導行業(ye)協(xie)會(hui)(hui)商會(hui)(hui)依(yi)法(fa)依(yi)規開(kai)展信(xin)用(yong)(yong)評價等活動,發揮(hui)其對成員的行為導引、規則(ze)約(yue)束、權益(yi)維護等作用(yong)(yong)。

(四)有序推進(jin)自(zi)然人(ren)(ren)信(xin)用建(jian)設(she)。依法(fa)依規(gui)建(jian)立(li)健全自(zi)然人(ren)(ren)信(xin)用記(ji)錄。加快推進(jin)法(fa)律、金融、會計、審計、醫(yi)療(liao)、教(jiao)育、家政(zheng)、工程建(jian)設(she)、生(sheng)態環境、平(ping)臺經濟(ji)等(deng)領域(yu)從業(ye)人(ren)(ren)員和取得國家職業(ye)資格人(ren)(ren)員等(deng)重點職業(ye)人(ren)(ren)群的(de)信(xin)用管(guan)理制度建(jian)設(she)。有條件的(de)地方和部門可以開展自(zi)然人(ren)(ren)信(xin)用評(ping)價,用作為守信(xin)主(zhu)體提(ti)供激勵政(zheng)策的(de)參考,嚴禁將非(fei)信(xin)用信(xin)息和個(ge)人(ren)(ren)私密信(xin)息納(na)入信(xin)用評(ping)價。

(五(wu))全(quan)面強(qiang)化司(si)法(fa)執(zhi)法(fa)體系信(xin)(xin)用(yong)(yong)建(jian)(jian)設(she)。加(jia)強(qiang)法(fa)院、檢察(cha)院司(si)法(fa)公(gong)(gong)信(xin)(xin)建(jian)(jian)設(she),提(ti)高司(si)法(fa)公(gong)(gong)信(xin)(xin)力。依法(fa)加(jia)大司(si)法(fa)公(gong)(gong)開力度,保障人(ren)民(min)群眾知情權。加(jia)強(qiang)司(si)法(fa)執(zhi)法(fa)人(ren)員信(xin)(xin)用(yong)(yong)建(jian)(jian)設(she),建(jian)(jian)立執(zhi)法(fa)人(ren)員信(xin)(xin)用(yong)(yong)記錄和信(xin)(xin)用(yong)(yong)承(cheng)諾制(zhi)度。提(ti)高虛假訴訟違法(fa)失(shi)信(xin)(xin)成本(ben)。嚴格失(shi)信(xin)(xin)被執(zhi)行人(ren)認定程序,優化相關(guan)失(shi)信(xin)(xin)懲戒措施。

三、夯實社(she)會信用體系(xi)數據基礎

(六(liu))建(jian)(jian)立全面完(wan)整準確的(de)(de)信(xin)用(yong)記(ji)錄(lu)(lu)。嚴(yan)格(ge)界(jie)定公(gong)共(gong)信(xin)用(yong)信(xin)息(xi)范圍(wei),行(xing)業主(zhu)管(guan)部門(men)要(yao)根據(ju)法律、行(xing)政法規(gui)、地方性(xing)法規(gui)或黨中(zhong)央、國(guo)務院(yuan)政策性(xing)文件確定本領(ling)域公(gong)共(gong)信(xin)用(yong)信(xin)息(xi)并形成行(xing)業信(xin)用(yong)記(ji)錄(lu)(lu),其(qi)中(zhong)屬于(yu)失信(xin)信(xin)息(xi)的(de)(de),要(yao)分類明確其(qi)失信(xin)嚴(yan)重程度。對公(gong)共(gong)信(xin)用(yong)信(xin)息(xi)統一(yi)實(shi)行(xing)目(mu)錄(lu)(lu)管(guan)理,國(guo)家發展改(gai)革(ge)委(wei)匯總(zong)建(jian)(jian)立相關主(zhu)體的(de)(de)完(wan)整信(xin)用(yong)記(ji)錄(lu)(lu)。

(七)強化信用(yong)(yong)信息(xi)(xi)(xi)歸集(ji)共(gong)(gong)享(xiang)(xiang)。強化全國信用(yong)(yong)信息(xi)(xi)(xi)共(gong)(gong)享(xiang)(xiang)平臺(tai)信用(yong)(yong)信息(xi)(xi)(xi)歸集(ji)共(gong)(gong)享(xiang)(xiang)“總樞(shu)紐”功能(neng),堅持以共(gong)(gong)享(xiang)(xiang)為原(yuan)則、不共(gong)(gong)享(xiang)(xiang)為例外,統一歸集(ji)各(ge)領域信用(yong)(yong)信息(xi)(xi)(xi),根(gen)據(ju)需求按規定向有關部門提供信用(yong)(yong)信息(xi)(xi)(xi)服務,定期(qi)開展歸集(ji)共(gong)(gong)享(xiang)(xiang)質效評估。推(tui)動全國信用(yong)(yong)信息(xi)(xi)(xi)共(gong)(gong)享(xiang)(xiang)平臺(tai)與行業(ye)信用(yong)(yong)信息(xi)(xi)(xi)系統深度聯(lian)通、數據(ju)共(gong)(gong)享(xiang)(xiang)。研(yan)究加強區(qu)塊鏈等技術(shu)在信用(yong)(yong)信息(xi)(xi)(xi)管理等方(fang)面的應用(yong)(yong),在保障信用(yong)(yong)主體合法權益和信息(xi)(xi)(xi)安全的前提下,提升商業(ye)合同信息(xi)(xi)(xi)、產業(ye)鏈信息(xi)(xi)(xi)、交易(yi)信息(xi)(xi)(xi)等共(gong)(gong)享(xiang)(xiang)水(shui)平。

(八)建立公(gong)(gong)共(gong)(gong)信(xin)(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)(xin)息(xi)統一(yi)公(gong)(gong)示制度。建立統一(yi)的(de)公(gong)(gong)共(gong)(gong)信(xin)(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)(xin)息(xi)公(gong)(gong)示標(biao)準規則(ze)。“信(xin)(xin)(xin)用(yong)(yong)(yong)中國(guo)”網(wang)(wang)站(zhan)集中公(gong)(gong)示各(ge)類公(gong)(gong)共(gong)(gong)信(xin)(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)(xin)息(xi),行業主管部門(men)原(yuan)則(ze)上不再(zai)公(gong)(gong)示本部門(men)業務(wu)領域之(zhi)外的(de)公(gong)(gong)共(gong)(gong)信(xin)(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)(xin)息(xi)。“信(xin)(xin)(xin)用(yong)(yong)(yong)中國(guo)”網(wang)(wang)站(zhan)按照公(gong)(gong)益性原(yuan)則(ze)向(xiang)社會公(gong)(gong)眾提供公(gong)(gong)共(gong)(gong)信(xin)(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)(xin)息(xi)查詢(xun)服務(wu)。對(dui)已在“信(xin)(xin)(xin)用(yong)(yong)(yong)中國(guo)”網(wang)(wang)站(zhan)公(gong)(gong)示的(de)公(gong)(gong)共(gong)(gong)信(xin)(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)(xin)息(xi),信(xin)(xin)(xin)用(yong)(yong)(yong)服務(wu)機構(gou)應當確保使用(yong)(yong)(yong)的(de)信(xin)(xin)(xin)用(yong)(yong)(yong)信(xin)(xin)(xin)息(xi)與公(gong)(gong)示內容相同、期限一(yi)致(zhi)。

(九(jiu))有序推動公(gong)(gong)共信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)信(xin)(xin)(xin)(xin)息(xi)(xi)(xi)開放流通。制定公(gong)(gong)共信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)信(xin)(xin)(xin)(xin)息(xi)(xi)(xi)授(shou)權(quan)運營(ying)(ying)管理(li)辦(ban)法,支(zhi)持符合(he)條件(jian)的運營(ying)(ying)機構(gou)依(yi)(yi)授(shou)權(quan)開展公(gong)(gong)共信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)信(xin)(xin)(xin)(xin)息(xi)(xi)(xi)資源(yuan)開發、產品經(jing)(jing)營(ying)(ying)和技術服務,嚴禁未(wei)經(jing)(jing)授(shou)權(quan)、超范(fan)圍使用(yong)(yong)(yong)(yong)公(gong)(gong)共信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)信(xin)(xin)(xin)(xin)息(xi)(xi)(xi)。建立公(gong)(gong)共信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)信(xin)(xin)(xin)(xin)息(xi)(xi)(xi)流通準入標(biao)準規則。鼓勵經(jing)(jing)營(ying)(ying)主體依(yi)(yi)法依(yi)(yi)規依(yi)(yi)托公(gong)(gong)共信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)信(xin)(xin)(xin)(xin)息(xi)(xi)(xi)提供公(gong)(gong)益服務。探索(suo)建立公(gong)(gong)共信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)信(xin)(xin)(xin)(xin)息(xi)(xi)(xi)價(jia)值(zhi)收益合(he)理(li)分享(xiang)機制,依(yi)(yi)法依(yi)(yi)規維護公(gong)(gong)共信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)信(xin)(xin)(xin)(xin)息(xi)(xi)(xi)資產權(quan)益。鼓勵區域間公(gong)(gong)共信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)信(xin)(xin)(xin)(xin)息(xi)(xi)(xi)共享(xiang)、信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)評價(jia)互認、信(xin)(xin)(xin)(xin)用(yong)(yong)(yong)(yong)獎懲(cheng)協同。

(十(shi))加(jia)強信(xin)(xin)用(yong)信(xin)(xin)息(xi)(xi)(xi)安(an)(an)(an)全(quan)(quan)保(bao)護。建(jian)立(li)信(xin)(xin)用(yong)信(xin)(xin)息(xi)(xi)(xi)安(an)(an)(an)全(quan)(quan)管理(li)(li)追溯(su)和(he)侵權責任(ren)追究(jiu)機制,明確信(xin)(xin)息(xi)(xi)(xi)傳輸鏈(lian)條各環節安(an)(an)(an)全(quan)(quan)責任(ren)。嚴格落實安(an)(an)(an)全(quan)(quan)保(bao)護責任(ren),規范(fan)信(xin)(xin)用(yong)信(xin)(xin)息(xi)(xi)(xi)處理(li)(li)程序。提高信(xin)(xin)用(yong)信(xin)(xin)息(xi)(xi)(xi)基礎(chu)設施安(an)(an)(an)全(quan)(quan)管理(li)(li)水(shui)平。建(jian)立(li)健全(quan)(quan)信(xin)(xin)用(yong)信(xin)(xin)息(xi)(xi)(xi)安(an)(an)(an)全(quan)(quan)應急處理(li)(li)機制。

四、健全守信(xin)激勵和失信(xin)懲(cheng)戒機制(zhi)

(十一)強化對守(shou)(shou)信行為(wei)(wei)的激(ji)勵。構(gou)建全方位的信用激(ji)勵政策環境,為(wei)(wei)守(shou)(shou)信主(zhu)體在公共服務(wu)中提(ti)供便(bian)利或(huo)優惠。鼓(gu)勵平臺(tai)企業用好大數據資(zi)源,為(wei)(wei)守(shou)(shou)信主(zhu)體精準提(ti)供市(shi)場(chang)化、社會化激(ji)勵。支持金(jin)融機構(gou)深入挖掘信用信息價值,持續提(ti)升(sheng)守(shou)(shou)信主(zhu)體融資(zi)便(bian)利化水平。

(十二(er))依(yi)法(fa)依(yi)規(gui)(gui)開展失(shi)信(xin)(xin)(xin)懲(cheng)戒(jie)(jie)(jie)。規(gui)(gui)范設(she)(she)定失(shi)信(xin)(xin)(xin)懲(cheng)戒(jie)(jie)(jie)措施(shi),依(yi)法(fa)依(yi)規(gui)(gui)合理(li)確(que)定懲(cheng)戒(jie)(jie)(jie)范圍(wei)和力度。設(she)(she)定失(shi)信(xin)(xin)(xin)懲(cheng)戒(jie)(jie)(jie)措施(shi)、確(que)定嚴(yan)(yan)重(zhong)(zhong)失(shi)信(xin)(xin)(xin)主體(ti)名單(dan)的設(she)(she)列領域必(bi)須(xu)以(yi)法(fa)律(lv)、行政(zheng)法(fa)規(gui)(gui)、地(di)方(fang)(fang)性法(fa)規(gui)(gui)或(huo)黨中央、國務(wu)院(yuan)政(zheng)策性文件為(wei)依(yi)據,其中涉及(ji)設(she)(she)定對(dui)(dui)信(xin)(xin)(xin)用主體(ti)減損權利或(huo)增加(jia)義(yi)務(wu)的措施(shi),必(bi)須(xu)以(yi)法(fa)律(lv)、行政(zheng)法(fa)規(gui)(gui)、地(di)方(fang)(fang)性法(fa)規(gui)(gui)為(wei)依(yi)據。行業主管部門應當以(yi)部門規(gui)(gui)章(zhang)形式明確(que)嚴(yan)(yan)重(zhong)(zhong)失(shi)信(xin)(xin)(xin)主體(ti)名單(dan)列入和退出的條件、程序。對(dui)(dui)被列入嚴(yan)(yan)重(zhong)(zhong)失(shi)信(xin)(xin)(xin)主體(ti)名單(dan)的,在申請(qing)政(zheng)府資金(jin)、享受稅收優惠、參與公(gong)共資源(yuan)(yuan)(yuan)交易(yi)活動、股票債券發行、評先評優、公(gong)務(wu)員錄用遴選調任聘(pin)任、事業單(dan)位公(gong)開招(zhao)聘(pin)等(deng)方(fang)(fang)面,依(yi)法(fa)依(yi)規(gui)(gui)予以(yi)限制或(huo)禁止(zhi)。在房地(di)產市場、互聯網、人力資源(yuan)(yuan)(yuan)市場、能(neng)源(yuan)(yuan)(yuan)中長期合同領域增設(she)(she)嚴(yan)(yan)重(zhong)(zhong)失(shi)信(xin)(xin)(xin)主體(ti)名單(dan)。對(dui)(dui)失(shi)信(xin)(xin)(xin)懲(cheng)戒(jie)(jie)(jie)措施(shi)和嚴(yan)(yan)重(zhong)(zhong)失(shi)信(xin)(xin)(xin)主體(ti)名單(dan)實行清單(dan)化統一管理(li)。

(十(shi)三)完(wan)善統(tong)一的(de)(de)信用(yong)修(xiu)(xiu)復(fu)(fu)(fu)制(zhi)度。建(jian)立健全統(tong)一規范、協(xie)同共享、科(ke)學高(gao)效的(de)(de)信用(yong)修(xiu)(xiu)復(fu)(fu)(fu)制(zhi)度,鼓勵失信主(zhu)體(ti)主(zhu)動糾正失信行(xing)為。國(guo)家發展改革委牽頭統(tong)一信用(yong)信息公示和修(xiu)(xiu)復(fu)(fu)(fu)的(de)(de)渠(qu)道(dao),優化信用(yong)修(xiu)(xiu)復(fu)(fu)(fu)規則,加強司法機(ji)關(guan)、行(xing)業主(zhu)管(guan)部門、信用(yong)服務機(ji)構等(deng)修(xiu)(xiu)復(fu)(fu)(fu)協(xie)同。對完(wan)成修(xiu)(xiu)復(fu)(fu)(fu)的(de)(de)信用(yong)主(zhu)體(ti),應當及時停止(zhi)公示其(qi)失信信息、將其(qi)移出相(xiang)關(guan)失信名(ming)單,并依法依規解除相(xiang)關(guan)失信懲(cheng)戒措施。

五、健全以(yi)信(xin)用為基礎的監管和治理機制

(十(shi)四(si))以(yi)信(xin)(xin)用評(ping)價為(wei)基(ji)礎實施分級分類監管(guan)(guan)。國(guo)家發展(zhan)改革(ge)委(wei)牽頭完善(shan)信(xin)(xin)用評(ping)價體(ti)系,各地區各行業主管(guan)(guan)部門以(yi)公共信(xin)(xin)用綜合評(ping)價為(wei)基(ji)礎健全(quan)本(ben)地區本(ben)行業信(xin)(xin)用評(ping)價機制,根據評(ping)價結(jie)果優化監管(guan)(guan)方(fang)式,對不同類型信(xin)(xin)用主體(ti)實施差異(yi)化監管(guan)(guan)。

(十五)建(jian)(jian)立(li)健全信(xin)(xin)(xin)用(yong)承(cheng)(cheng)諾(nuo)(nuo)制(zhi)。在行(xing)政審批(pi)、證明事項、信(xin)(xin)(xin)用(yong)修復等領域推(tui)行(xing)信(xin)(xin)(xin)用(yong)承(cheng)(cheng)諾(nuo)(nuo)制(zhi)。辦理適用(yong)信(xin)(xin)(xin)用(yong)承(cheng)(cheng)諾(nuo)(nuo)制(zhi)的(de)事項時(shi),申請人部分申報材料(liao)不(bu)齊備但(dan)信(xin)(xin)(xin)用(yong)狀況較好且書(shu)面承(cheng)(cheng)諾(nuo)(nuo)在規定期限內(nei)提供材料(liao)的(de),應先行(xing)受理。建(jian)(jian)立(li)信(xin)(xin)(xin)用(yong)承(cheng)(cheng)諾(nuo)(nuo)踐諾(nuo)(nuo)跟蹤機(ji)制(zhi)。引導信(xin)(xin)(xin)用(yong)主(zhu)體主(zhu)動向社會作出(chu)信(xin)(xin)(xin)用(yong)承(cheng)(cheng)諾(nuo)(nuo)。

(十六)推進信(xin)用報告(gao)深度應用。推動(dong)在市場準入、行(xing)(xing)政(zheng)審批、政(zheng)府采購、招商引資(zi)、資(zi)質審核等公共管(guan)理領域充分使用信(xin)用報告(gao)。大力(li)推行(xing)(xing)以專項信(xin)用報告(gao)替代有無違法違規記(ji)錄的(de)證明。鼓(gu)勵在招標投標、融(rong)資(zi)授信(xin)、商業往來等市場交易活動(dong)中(zhong)使用信(xin)用報告(gao)。

(十七)加強對政(zheng)府簽(qian)訂(ding)、指(zhi)導(dao)簽(qian)訂(ding)合(he)(he)同(tong)(tong)等履(lv)(lv)約信用(yong)監管。強化(hua)合(he)(he)同(tong)(tong)履(lv)(lv)約跟蹤核實,及(ji)時將政(zheng)府簽(qian)訂(ding)的合(he)(he)同(tong)(tong)、政(zheng)府指(zhi)導(dao)簽(qian)訂(ding)的合(he)(he)同(tong)(tong)等履(lv)(lv)約情況歸集(ji)至(zhi)全國信用(yong)信息共享平臺,國家發展改(gai)革委將經核實的合(he)(he)同(tong)(tong)履(lv)(lv)約情況納(na)入相關主體信用(yong)記錄,切實提高合(he)(he)同(tong)(tong)履(lv)(lv)約水平。

(十八)推(tui)動信(xin)用(yong)賦能(neng)基層治(zhi)(zhi)理。加(jia)(jia)強(qiang)農(nong)村信(xin)用(yong)體系建設,加(jia)(jia)強(qiang)涉(she)農(nong)信(xin)用(yong)信(xin)息歸集(ji)共(gong)享,明確采集(ji)責任,優化精簡采集(ji)指標和(he)評(ping)價規則,提升對農(nong)戶和(he)新型農(nong)業經營主(zhu)體的信(xin)用(yong)評(ping)價水平。推(tui)動信(xin)用(yong)賦能(neng)社區治(zhi)(zhi)理,支持(chi)信(xin)用(yong)園區、街區建設。

(十九)完(wan)善(shan)社(she)會信(xin)用(yong)體系法(fa)律法(fa)規(gui)制(zhi)度。完(wan)善(shan)統(tong)一社(she)會信(xin)用(yong)代碼制(zhi)度,進一步明確各類(lei)主體的(de)賦(fu)碼部門(men),健全賦(fu)碼數(shu)據共享與校核(he)機(ji)制(zhi)。制(zhi)定(ding)全國統(tong)一的(de)信(xin)用(yong)信(xin)息管(guan)(guan)理標準。推(tui)動出臺(tai)(tai)社(she)會信(xin)用(yong)建(jian)設法(fa),推(tui)動將信(xin)用(yong)規(gui)則納入相關(guan)專項(xiang)法(fa)律法(fa)規(gui)。加(jia)強信(xin)用(yong)政策(ce)出臺(tai)(tai)前的(de)綜合評估,防(fang)止信(xin)用(yong)管(guan)(guan)理措施泛化濫用(yong)。

六、提高社(she)會(hui)信用體系市場化社(she)會(hui)化水平

(二十)大力培(pei)育(yu)信(xin)(xin)(xin)用(yong)服(fu)務(wu)市場。創新信(xin)(xin)(xin)用(yong)評(ping)(ping)價、信(xin)(xin)(xin)用(yong)評(ping)(ping)級、信(xin)(xin)(xin)用(yong)評(ping)(ping)分、信(xin)(xin)(xin)用(yong)報告、信(xin)(xin)(xin)用(yong)核查、信(xin)(xin)(xin)用(yong)管理(li)、信(xin)(xin)(xin)用(yong)咨(zi)詢以及環(huan)境、社會(hui)和治理(li)評(ping)(ping)價等(deng)業務(wu)模式(shi),有效(xiao)支(zhi)撐信(xin)(xin)(xin)用(yong)經(jing)濟發(fa)(fa)展(zhan)。規(gui)范信(xin)(xin)(xin)用(yong)服(fu)務(wu)機構(gou)參(can)與社會(hui)信(xin)(xin)(xin)用(yong)體系建設行(xing)為(wei)。支(zhi)持(chi)金融信(xin)(xin)(xin)用(yong)信(xin)(xin)(xin)息基礎數(shu)據庫依法采(cai)集金融領域信(xin)(xin)(xin)用(yong)信(xin)(xin)(xin)息,提供(gong)更加(jia)(jia)便捷優質(zhi)的基礎征(zheng)(zheng)信(xin)(xin)(xin)服(fu)務(wu)。優化個(ge)人征(zheng)(zheng)信(xin)(xin)(xin)市場布(bu)局,增(zeng)加(jia)(jia)個(ge)人征(zheng)(zheng)信(xin)(xin)(xin)產品和服(fu)務(wu)供(gong)給。做優做精企業征(zheng)(zheng)信(xin)(xin)(xin)市場,探索發(fa)(fa)展(zhan)聚焦細分領域的企業征(zheng)(zheng)信(xin)(xin)(xin)機構(gou)。全面加(jia)(jia)強征(zheng)(zheng)信(xin)(xin)(xin)監管,促(cu)進征(zheng)(zheng)信(xin)(xin)(xin)行(xing)業規(gui)范健康發(fa)(fa)展(zhan)。

(二(er)十一(yi))深入(ru)(ru)推進信(xin)(xin)(xin)用(yong)融(rong)(rong)資和信(xin)(xin)(xin)用(yong)交易。依(yi)(yi)托全國一(yi)體化融(rong)(rong)資信(xin)(xin)(xin)用(yong)服務(wu)(wu)平臺網絡,按照實(shi)際(ji)應用(yong)需(xu)求(qiu)擴大(da)信(xin)(xin)(xin)用(yong)信(xin)(xin)(xin)息(xi)歸集(ji)共享范圍,完善(shan)以(yi)信(xin)(xin)(xin)用(yong)信(xin)(xin)(xin)息(xi)為(wei)基礎的企業(ye)融(rong)(rong)資增信(xin)(xin)(xin)制度,有(you)效提升中小微(wei)企業(ye)信(xin)(xin)(xin)用(yong)貸款(kuan)比重,支持符合條件(jian)的征信(xin)(xin)(xin)機(ji)(ji)構參與融(rong)(rong)資信(xin)(xin)(xin)用(yong)服務(wu)(wu)平臺運營。鼓(gu)勵信(xin)(xin)(xin)用(yong)服務(wu)(wu)機(ji)(ji)構依(yi)(yi)法依(yi)(yi)規采集(ji)商業(ye)合同履(lv)約(yue)(yue)信(xin)(xin)(xin)息(xi),支持有(you)序推廣賒銷、分(fen)期付款(kuan)、融(rong)(rong)資租賃等(deng)信(xin)(xin)(xin)用(yong)銷售模式。強化商業(ye)匯票信(xin)(xin)(xin)息(xi)披露,完善(shan)票據市場信(xin)(xin)(xin)用(yong)約(yue)(yue)束機(ji)(ji)制。將惡意逃廢債經營主體依(yi)(yi)法依(yi)(yi)規納(na)入(ru)(ru)相關嚴(yan)重失信(xin)(xin)(xin)主體名單。

(二十(shi)二)加強平(ping)(ping)(ping)臺經(jing)濟(ji)領域信(xin)用建設。加強公共(gong)信(xin)用信(xin)息和平(ping)(ping)(ping)臺企業(ye)經(jing)營(ying)(ying)(ying)信(xin)息的(de)共(gong)享,引(yin)導平(ping)(ping)(ping)臺企業(ye)建立平(ping)(ping)(ping)臺內信(xin)用管理制(zhi)度和平(ping)(ping)(ping)臺間失信(xin)聯合約束制(zhi)度,根據平(ping)(ping)(ping)臺內商(shang)戶(hu)信(xin)用狀(zhuang)況(kuang)實施差別(bie)化的(de)管理和服(fu)務,為守法(fa)(fa)誠信(xin)經(jing)營(ying)(ying)(ying)主(zhu)體(ti)提供更(geng)多(duo)優惠便利,對違(wei)法(fa)(fa)失信(xin)經(jing)營(ying)(ying)(ying)主(zhu)體(ti)在(zai)平(ping)(ping)(ping)臺規(gui)則(ze)內予(yu)以(yi)限制(zhi)。加強對網(wang)絡(luo)主(zhu)播(bo)、自媒體(ti)、網(wang)絡(luo)信(xin)息內容(rong)多(duo)渠道分發服(fu)務機構(gou)(MCN機構(gou))等信(xin)用監管。

(二十三)服(fu)(fu)務(wu)(wu)高水(shui)平對外開(kai)(kai)放。在(zai)確保安全的(de)前提下,依(yi)法依(yi)規推(tui)進信(xin)(xin)用(yong)信(xin)(xin)息(xi)數據(ju)跨(kua)境(jing)流通(tong),有序開(kai)(kai)展跨(kua)境(jing)信(xin)(xin)用(yong)合(he)作,推(tui)動(dong)信(xin)(xin)用(yong)評價、信(xin)(xin)用(yong)報告等(deng)信(xin)(xin)用(yong)產品(pin)跨(kua)境(jing)互認。支持國(guo)(guo)(guo)(guo)內(nei)信(xin)(xin)用(yong)服(fu)(fu)務(wu)(wu)機構(gou)與共建(jian)“一帶一路”國(guo)(guo)(guo)(guo)家、金磚國(guo)(guo)(guo)(guo)家開(kai)(kai)展獨立(li)、公正的(de)第(di)三方(fang)信(xin)(xin)用(yong)服(fu)(fu)務(wu)(wu)合(he)作。加(jia)強國(guo)(guo)(guo)(guo)際(ji)征信(xin)(xin)交流,積極培(pei)育(yu)具(ju)有國(guo)(guo)(guo)(guo)際(ji)競(jing)爭力和影響力的(de)征信(xin)(xin)機構(gou)。推(tui)動(dong)國(guo)(guo)(guo)(guo)內(nei)信(xin)(xin)用(yong)評級機構(gou)國(guo)(guo)(guo)(guo)際(ji)化發(fa)展。

各(ge)地(di)區(qu)各(ge)有關部門(men)要(yao)在黨中央集中統一(yi)領(ling)導下,結合實(shi)(shi)際抓(zhua)好本意見貫徹(che)落(luo)實(shi)(shi),形(xing)成(cheng)上下聯動(dong)、各(ge)司其職、齊抓(zhua)共管的(de)工(gong)(gong)作格局。國(guo)(guo)家發展(zhan)改革(ge)委、中國(guo)(guo)人民銀行(xing)要(yao)加強(qiang)統籌(chou)協調,各(ge)有關部門(men)要(yao)切實(shi)(shi)履行(xing)本領(ling)域信(xin)(xin)用建(jian)設責任(ren),形(xing)成(cheng)工(gong)(gong)作合力(li)。統籌(chou)做(zuo)好全國(guo)(guo)社(she)會信(xin)(xin)用體系建(jian)設示(shi)范(fan)(fan)區(qu)創建(jian)工(gong)(gong)作,建(jian)立(li)健全示(shi)范(fan)(fan)區(qu)后(hou)評價機制。持續(xu)開展(zhan)城市(shi)信(xin)(xin)用監測(ce)。弘揚誠(cheng)(cheng)信(xin)(xin)文化(hua),普及(ji)誠(cheng)(cheng)信(xin)(xin)教育,依(yi)法(fa)依(yi)規加大對嚴重(zhong)失(shi)信(xin)(xin)行(xing)為的(de)曝光(guang)力(li)度,支持新聞媒體開展(zhan)誠(cheng)(cheng)信(xin)(xin)宣(xuan)傳(chuan)和(he)輿論監督(du)。充分發揮誠(cheng)(cheng)信(xin)(xin)典型的(de)引領(ling)作用,持續(xu)開展(zhan)“誠(cheng)(cheng)信(xin)(xin)之星”宣(xuan)傳(chuan)和(he)“誠(cheng)(cheng)信(xin)(xin)興商宣(xuan)傳(chuan)月”活(huo)動(dong),推(tui)動(dong)形(xing)成(cheng)守信(xin)(xin)踐諾的(de)良好社(she)會風尚。及(ji)時總結推(tui)廣典型經(jing)驗做(zuo)法(fa)。重(zhong)大事項及(ji)時按程序向(xiang)黨中央、國(guo)(guo)務院請(qing)示(shi)報告。
