黨的(de)十八大(da)以來,習近(jin)(jin)平總書記就生(sheng)(sheng)態(tai)文明(ming)(ming)建設發表一(yi)系列重(zhong)要講話、作(zuo)出一(yi)系列重(zhong)要指(zhi)示,形成了習近(jin)(jin)平生(sheng)(sheng)態(tai)文明(ming)(ming)思(si)想(xiang),是美麗(li)中(zhong)(zhong)國建設的(de)科學指(zhi)引和根本(ben)遵循。十三(san)屆全國人(ren)大(da)及其常委會深入學習貫徹習近(jin)(jin)平生(sheng)(sheng)態(tai)文明(ming)(ming)思(si)想(xiang),緊緊圍繞黨中(zhong)(zhong)央決(jue)策部(bu)署,把依(yi)法(fa)(fa)保護生(sheng)(sheng)態(tai)環境作(zuo)為立法(fa)(fa)、監督工作(zuo)的(de)重(zhong)中(zhong)(zhong)之(zhi)重(zhong),始終(zhong)抓在手(shou)上,連(lian)續五年(nian)開展大(da)氣污(wu)染防(fang)(fang)治(zhi)法(fa)(fa)、水污(wu)染防(fang)(fang)治(zhi)法(fa)(fa)、土壤污(wu)染防(fang)(fang)治(zhi)法(fa)(fa)、固體(ti)廢物污(wu)染環境防(fang)(fang)治(zhi)法(fa)(fa)、環境保護法(fa)(fa)等(deng)10部(bu)生(sheng)(sheng)態(tai)環保法(fa)(fa)律和相關決(jue)定的(de)執法(fa)(fa)檢(jian)查(cha),栗戰(zhan)(zhan)書委員長(chang)6次擔任執法(fa)(fa)檢(jian)查(cha)組(zu)組(zu)長(chang),10次帶隊赴地方(fang)檢(jian)查(cha),規格之(zhi)高、力度之(zhi)大(da)、影(ying)響(xiang)之(zhi)廣、成效之(zhi)好前所(suo)未有(you),為依(yi)法(fa)(fa)打(da)好污(wu)染防(fang)(fang)治(zhi)攻堅(jian)戰(zhan)(zhan)、推進生(sheng)(sheng)態(tai)文明(ming)(ming)建設作(zuo)出了人(ren)大(da)貢(gong)獻(xian)。

按(an)照執法檢(jian)查(cha)(cha)(cha)工作(zuo)安(an)排,執法檢(jian)查(cha)(cha)(cha)組(zu)由栗(li)戰(zhan)書委(wei)(wei)員(yuan)(yuan)(yuan)長(chang)(chang)擔(dan)任組(zu)長(chang)(chang),張春賢、沈躍(yue)(yue)躍(yue)(yue)、丁仲禮副委(wei)(wei)員(yuan)(yuan)(yuan)長(chang)(chang)、楊振武秘書長(chang)(chang)和(he)環(huan)資委(wei)(wei)高虎城主任委(wei)(wei)員(yuan)(yuan)(yuan)任副組(zu)長(chang)(chang),成(cheng)員(yuan)(yuan)(yuan)由全(quan)國人大(da)常(chang)委(wei)(wei)會(hui)委(wei)(wei)員(yuan)(yuan)(yuan)、環(huan)資委(wei)(wei)委(wei)(wei)員(yuan)(yuan)(yuan)和(he)部分(fen)全(quan)國人大(da)代表共(gong)31人組(zu)成(cheng)。3月至6月,栗(li)戰(zhan)書委(wei)(wei)員(yuan)(yuan)(yuan)長(chang)(chang)和(he)三位(wei)副委(wei)(wei)員(yuan)(yuan)(yuan)長(chang)(chang)分(fen)別帶隊,赴黑龍江(jiang)、山(shan)西、西藏、寧夏、福建(jian)、四川、江(jiang)蘇7個(ge)省(自治區(qu))開(kai)(kai)展(zhan)檢(jian)查(cha)(cha)(cha),檢(jian)查(cha)(cha)(cha)組(zu)深入到20個(ge)地市(shi),召開(kai)(kai)16次座談會(hui),聽取地方政府和(he)有關部門的(de)匯報,實地查(cha)(cha)(cha)看了101個(ge)單位(wei)和(he)項目。同時,委(wei)(wei)托各省(自治區(qu)、直轄市(shi))人大(da)常(chang)委(wei)(wei)會(hui)對本(ben)行政區(qu)域法律實施情況開(kai)(kai)展(zhan)了檢(jian)查(cha)(cha)(cha)。

這次執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)檢(jian)(jian)(jian)查(cha)有幾個特點:一是(shi)(shi)始終堅持以習(xi)近平生態(tai)(tai)(tai)文(wen)明思(si)想(xiang)(xiang)為根本(ben)遵循,把(ba)學習(xi)宣(xuan)傳貫(guan)(guan)(guan)徹(che)習(xi)近平生態(tai)(tai)(tai)文(wen)明思(si)想(xiang)(xiang)作(zuo)(zuo)(zuo)為重(zhong)(zhong)大(da)(da)(da)政治(zhi)(zhi)任務貫(guan)(guan)(guan)穿(chuan)執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)檢(jian)(jian)(jian)查(cha)全(quan)(quan)(quan)過(guo)程(cheng)(cheng),堅決(jue)貫(guan)(guan)(guan)徹(che)習(xi)近平總書記關(guan)于(yu)生態(tai)(tai)(tai)環境(jing)保(bao)護(hu)(hu)的(de)重(zhong)(zhong)要(yao)指示(shi)精神,以法(fa)(fa)治(zhi)(zhi)思(si)維、法(fa)(fa)治(zhi)(zhi)方式推動黨(dang)中央決(jue)策部署貫(guan)(guan)(guan)徹(che)落實。二是(shi)(shi)堅持依法(fa)(fa)監(jian)督(du),緊(jin)扣法(fa)(fa)律(lv)制度(du)規(gui)定(ding)(ding),逐(zhu)條對(dui)照(zhao)法(fa)(fa)律(lv)條文(wen),檢(jian)(jian)(jian)查(cha)法(fa)(fa)定(ding)(ding)職責是(shi)(shi)否(fou)履行(xing)、法(fa)(fa)律(lv)責任是(shi)(shi)否(fou)落實、法(fa)(fa)律(lv)執(zhi)(zhi)(zhi)(zhi)行(xing)效(xiao)果(guo)是(shi)(shi)否(fou)明顯,推動在(zai)法(fa)(fa)治(zhi)(zhi)軌道上治(zhi)(zhi)理污染、保(bao)護(hu)(hu)生態(tai)(tai)(tai)環境(jing)。三(san)是(shi)(shi)堅持全(quan)(quan)(quan)過(guo)程(cheng)(cheng)人(ren)(ren)(ren)民(min)(min)民(min)(min)主(zhu),充分發(fa)揮人(ren)(ren)(ren)大(da)(da)(da)代(dai)表(biao)(biao)作(zuo)(zuo)(zuo)用(yong),在(zai)執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)檢(jian)(jian)(jian)查(cha)的(de)全(quan)(quan)(quan)過(guo)程(cheng)(cheng)、各(ge)環節邀請人(ren)(ren)(ren)大(da)(da)(da)代(dai)表(biao)(biao)參(can)加(jia),召開(kai)五級人(ren)(ren)(ren)大(da)(da)(da)代(dai)表(biao)(biao)座談會(hui)(hui),全(quan)(quan)(quan)國人(ren)(ren)(ren)大(da)(da)(da)常(chang)委(wei)(wei)會(hui)(hui)辦公廳(ting)會(hui)(hui)同各(ge)省(自(zi)(zi)治(zhi)(zhi)區、直轄市)人(ren)(ren)(ren)大(da)(da)(da)常(chang)委(wei)(wei)會(hui)(hui)組(zu)(zu)織(zhi)475名代(dai)表(biao)(biao)開(kai)展(zhan)(zhan)(zhan)專題調研,帶(dai)頭(tou)貫(guan)(guan)(guan)徹(che)實施(shi)法(fa)(fa)律(lv),就(jiu)地(di)就(jiu)近就(jiu)便(bian)開(kai)展(zhan)(zhan)(zhan)監(jian)督(du)。四是(shi)(shi)加(jia)大(da)(da)(da)法(fa)(fa)律(lv)學習(xi)宣(xuan)傳力(li)度(du),2900多(duo)萬人(ren)(ren)(ren)參(can)加(jia)“學習(xi)強國”環境(jing)保(bao)護(hu)(hu)法(fa)(fa)知(zhi)識專項答題,各(ge)地(di)人(ren)(ren)(ren)大(da)(da)(da)組(zu)(zu)織(zhi)41萬余(yu)人(ren)(ren)(ren)參(can)與問卷(juan)調查(cha),有力(li)推動黨(dang)員干(gan)部和社會(hui)(hui)公眾學習(xi)法(fa)(fa)律(lv)知(zhi)識,提高(gao)法(fa)(fa)治(zhi)(zhi)意(yi)識。五是(shi)(shi)科(ke)學開(kai)展(zhan)(zhan)(zhan)評估(gu)。委(wei)(wei)托有關(guan)技術(shu)機構對(dui)環境(jing)保(bao)護(hu)(hu)法(fa)(fa)實施(shi)情況進行(xing)第三(san)方評估(gu),提高(gao)監(jian)督(du)工(gong)作(zuo)(zuo)(zuo)的(de)科(ke)學性、專業性。六是(shi)(shi)堅持上下(xia)聯(lian)動,形成了人(ren)(ren)(ren)大(da)(da)(da)監(jian)督(du)強大(da)(da)(da)合力(li)。各(ge)地(di)人(ren)(ren)(ren)大(da)(da)(da)常(chang)委(wei)(wei)會(hui)(hui)高(gao)度(du)重(zhong)(zhong)視(shi),遼寧、山東、廣西(xi)、新疆等省(自(zi)(zi)治(zhi)(zhi)區)黨(dang)委(wei)(wei)書記、人(ren)(ren)(ren)大(da)(da)(da)常(chang)委(wei)(wei)會(hui)(hui)主(zhu)任帶(dai)隊開(kai)展(zhan)(zhan)(zhan)執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)檢(jian)(jian)(jian)查(cha),全(quan)(quan)(quan)國人(ren)(ren)(ren)大(da)(da)(da)常(chang)委(wei)(wei)會(hui)(hui)執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)檢(jian)(jian)(jian)查(cha)組(zu)(zu)所到的(de)7個省(自(zi)(zi)治(zhi)(zhi)區)人(ren)(ren)(ren)大(da)(da)(da)常(chang)委(wei)(wei)會(hui)(hui)同步開(kai)展(zhan)(zhan)(zhan)執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)檢(jian)(jian)(jian)查(cha),黑龍(long)江在(zai)認(ren)真(zhen)組(zu)(zu)織(zhi)開(kai)展(zhan)(zhan)(zhan)執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)檢(jian)(jian)(jian)查(cha)后,全(quan)(quan)(quan)面(mian)開(kai)展(zhan)(zhan)(zhan)“回頭(tou)看”,依法(fa)(fa)推動發(fa)現問題整(zheng)改落實。北京、吉林、上海等地(di)克服疫情影響(xiang),采取(qu)線(xian)(xian)上線(xian)(xian)下(xia)相結合的(de)方式,安全(quan)(quan)(quan)有序(xu)扎實開(kai)展(zhan)(zhan)(zhan)執(zhi)(zhi)(zhi)(zhi)法(fa)(fa)檢(jian)(jian)(jian)查(cha)工(gong)作(zuo)(zuo)(zuo),推動法(fa)(fa)律(lv)有效(xiao)實施(shi)。

一、我(wo)國環境狀況發生歷史性變化

黨的十(shi)八大以(yi)(yi)來,以(yi)(yi)習近平同(tong)志為(wei)核心(xin)的黨中央把(ba)生(sheng)態文(wen)明建設(she)納(na)入(ru)“五(wu)位一體(ti)”總體(ti)布局,把(ba)美麗中國作為(wei)生(sheng)態文(wen)明建設(she)的宏(hong)偉目標,堅決向污染宣戰,以(yi)(yi)前所未有的力度抓(zhua)環境(jing)保護,推(tui)進生(sheng)態文(wen)明建設(she),全(quan)(quan)方位、全(quan)(quan)地域、全(quan)(quan)過程加強生(sheng)態環境(jing)保護,我國生(sheng)態環境(jing)發生(sheng)了歷史性(xing)、轉折(zhe)性(xing)、全(quan)(quan)局性(xing)變(bian)化。

(一)環境質量(liang)顯著改善。污(wu)染防治攻堅戰(zhan)階(jie)段(duan)性目標如期完(wan)成,生態(tai)環境更加優美(mei)。與(yu)2015年(nian)相比,2021年(nian)全國地(di)級及以上城市細顆(ke)粒物(wu)(PM2.5)平均濃度下降(jiang)34.8%、降(jiang)至(zhi)30微克/立方(fang)米,城市空(kong)氣質(zhi)(zhi)量優(you)良天數比(bi)(bi)率(lv)提高6.3個(ge)百(bai)分(fen)(fen)點(dian)、達(da)(da)(da)(da)到(dao)(dao)87.5%,重污(wu)染(ran)天數減少53.6%,不少地方(fang)空(kong)氣質(zhi)(zhi)量達(da)(da)(da)(da)到(dao)(dao)歷史(shi)最好水平。全(quan)國(guo)地表水優(you)良水質(zhi)(zhi)斷(duan)面(mian)(mian)比(bi)(bi)例提高18.9個(ge)百(bai)分(fen)(fen)點(dian)、達(da)(da)(da)(da)到(dao)(dao)84.9%,劣Ⅴ類(lei)水體比(bi)(bi)例下降(jiang)至(zhi)1.2%。長江干(gan)流全(quan)線(xian)連續兩(liang)年達(da)(da)(da)(da)到(dao)(dao)Ⅱ類(lei)水體,黃河干(gan)流全(quan)線(xian)達(da)(da)(da)(da)到(dao)(dao)Ⅲ類(lei)水體。全(quan)國(guo)近岸海域水質(zhi)(zhi)優(you)良面(mian)(mian)積比(bi)(bi)率(lv)提高約12.9個(ge)百(bai)分(fen)(fen)點(dian)、達(da)(da)(da)(da)到(dao)(dao)81.3%。全(quan)國(guo)受污(wu)染(ran)耕地安(an)全(quan)利(li)用率(lv)和(he)污(wu)染(ran)地塊安(an)全(quan)利(li)用率(lv)雙雙超過90%,全(quan)面(mian)(mian)禁(jin)止(zhi)洋垃圾(ji)入境,突發環境事件(jian)數量逐(zhu)年下降(jiang)。第三方(fang)評估報告顯示,社會(hui)公眾認同生(sheng)態(tai)環境質(zhi)(zhi)量明(ming)顯改(gai)善(shan)或改(gai)善(shan)的(de)(de)占比(bi)(bi)達(da)(da)(da)(da)88%,綠(lv)水青(qing)山的(de)(de)“生(sheng)態(tai)顏值(zhi)”和(he)人(ren)民生(sheng)活(huo)的(de)(de)“幸福(fu)指數”同步提升(sheng)。

(二(er))綠(lv)色發(fa)展成效不(bu)斷顯現。各地(di)區(qu)各部門堅決貫(guan)徹新(xin)發展(zhan)理(li)念(nian),加快形(xing)成節約資(zi)源(yuan)(yuan)(yuan)和(he)保(bao)護環(huan)境的(de)(de)空間格局、產(chan)(chan)(chan)業結構、生(sheng)產(chan)(chan)(chan)方式、生(sheng)活方式,生(sheng)態環(huan)境保(bao)護理(li)念(nian)和(he)實踐融入經濟社會發展(zhan)的(de)(de)各方面全過程。黨(dang)的(de)(de)十(shi)八大以來,我國累計淘汰(tai)鋼鐵產(chan)(chan)(chan)能(neng)(neng)(neng)近3億噸(dun),2021年(nian)煤炭消費占比(bi)下(xia)(xia)降(jiang)到56%,清潔能(neng)(neng)(neng)源(yuan)(yuan)(yuan)消費占比(bi)提高(gao)到25.5%。全國單位GDP能(neng)(neng)(neng)耗下(xia)(xia)降(jiang)、用水量大幅降(jiang)低,我國可再生(sheng)能(neng)(neng)(neng)源(yuan)(yuan)(yuan)開發利(li)用規模(mo)、新(xin)能(neng)(neng)(neng)源(yuan)(yuan)(yuan)汽車產(chan)(chan)(chan)銷量穩(wen)居世界第(di)一。綠(lv)色日益成為(wei)經濟社會高(gao)質量發展(zhan)的(de)(de)鮮明底色。

(三(san))生(sheng)態(tai)系統得(de)到(dao)持(chi)續(xu)修復。黨的十八大(da)以來,我國(guo)累計完成(cheng)造林9.6億(yi)畝,占(zhan)全球人工造林的1/4。森(sen)林覆(fu)蓋(gai)率(lv)達到(dao)(dao)23.04%,森(sen)林蓄積量(liang)提高(gao)到(dao)(dao)175.6萬億(yi)立方米,森(sen)林覆(fu)蓋(gai)率(lv)和(he)森(sen)林蓄積量(liang)連續保持“雙增(zeng)長”,我國(guo)成(cheng)為全球森(sen)林資源增(zeng)長最多的國(guo)家。2021年(nian),草原綜合植(zhi)被(bei)蓋(gai)度達到(dao)(dao)56.1%,濕地(di)保護率(lv)達到(dao)(dao)52.65%。水土(tu)流(liu)失面(mian)積較上世(shi)紀80年(nian)代監測最高(gao)值減(jian)少97.76萬平方公里,水土(tu)流(liu)失面(mian)積和(he)強度“雙下降”,荒漠化、沙化土(tu)地(di)面(mian)積“雙縮減(jian)”,300多種珍(zhen)稀(xi)瀕危(wei)野生(sheng)動(dong)植(zhi)物野外種群數量(liang)穩中有升,生(sheng)態(tai)安(an)全屏障越來越穩固。

(四)生態環保法律體(ti)系基本形成。黨的(de)(de)(de)十(shi)八大(da)以來,全國人(ren)大(da)常委會堅決貫(guan)徹習近平生態(tai)(tai)文明思(si)想(xiang),加快生態(tai)(tai)環(huan)(huan)保(bao)(bao)(bao)(bao)領(ling)域立(li)法(fa)(fa)(fa)(fa)(fa)(fa)步伐,實(shi)現了從(cong)量到質的(de)(de)(de)全面(mian)(mian)提(ti)升(sheng)。2014年全面(mian)(mian)修改(gai)的(de)(de)(de)環(huan)(huan)境(jing)(jing)保(bao)(bao)(bao)(bao)護(hu)(hu)(hu)(hu)法(fa)(fa)(fa)(fa)(fa)(fa),被(bei)稱為“史上最嚴格”的(de)(de)(de)環(huan)(huan)境(jing)(jing)保(bao)(bao)(bao)(bao)護(hu)(hu)(hu)(hu)法(fa)(fa)(fa)(fa)(fa)(fa)。2018年,十(shi)三屆全國人(ren)大(da)一次(ci)會議通過憲(xian)法(fa)(fa)(fa)(fa)(fa)(fa)修正(zheng)案(an),將(jiang)生態(tai)(tai)文明寫(xie)入(ru)憲(xian)法(fa)(fa)(fa)(fa)(fa)(fa)。憲(xian)法(fa)(fa)(fa)(fa)(fa)(fa)和67件法(fa)(fa)(fa)(fa)(fa)(fa)律(lv)對生態(tai)(tai)環(huan)(huan)保(bao)(bao)(bao)(bao)作(zuo)(zuo)出規定,涵蓋(gai)法(fa)(fa)(fa)(fa)(fa)(fa)律(lv)體(ti)(ti)系全部(bu)(bu)7個法(fa)(fa)(fa)(fa)(fa)(fa)律(lv)部(bu)(bu)門。本屆全國人(ren)大(da)常委會先后(hou)制定或修改(gai)土壤污(wu)(wu)染(ran)防(fang)(fang)(fang)治法(fa)(fa)(fa)(fa)(fa)(fa)、固(gu)體(ti)(ti)廢物污(wu)(wu)染(ran)環(huan)(huan)境(jing)(jing)防(fang)(fang)(fang)治法(fa)(fa)(fa)(fa)(fa)(fa)、生物安(an)全法(fa)(fa)(fa)(fa)(fa)(fa)、長江保(bao)(bao)(bao)(bao)護(hu)(hu)(hu)(hu)法(fa)(fa)(fa)(fa)(fa)(fa)、濕地保(bao)(bao)(bao)(bao)護(hu)(hu)(hu)(hu)法(fa)(fa)(fa)(fa)(fa)(fa)、黑(hei)土地保(bao)(bao)(bao)(bao)護(hu)(hu)(hu)(hu)法(fa)(fa)(fa)(fa)(fa)(fa)等(deng)生態(tai)(tai)環(huan)(huan)保(bao)(bao)(bao)(bao)法(fa)(fa)(fa)(fa)(fa)(fa)律(lv)17件次(ci),作(zuo)(zuo)出關于全面(mian)(mian)加強(qiang)生態(tai)(tai)環(huan)(huan)境(jing)(jing)保(bao)(bao)(bao)(bao)護(hu)(hu)(hu)(hu)、依法(fa)(fa)(fa)(fa)(fa)(fa)推動打好污(wu)(wu)染(ran)防(fang)(fang)(fang)治攻堅戰的(de)(de)(de)決議,正(zheng)在審(shen)議黃河保(bao)(bao)(bao)(bao)護(hu)(hu)(hu)(hu)法(fa)(fa)(fa)(fa)(fa)(fa)等(deng)3部(bu)(bu)法(fa)(fa)(fa)(fa)(fa)(fa)律(lv)草案(an)。兩次(ci)修正(zheng)刑(xing)法(fa)(fa)(fa)(fa)(fa)(fa),降低環(huan)(huan)境(jing)(jing)與(yu)資源保(bao)(bao)(bao)(bao)護(hu)(hu)(hu)(hu)犯(fan)罪入(ru)罪門檻,將(jiang)環(huan)(huan)評、監測弄(nong)虛作(zuo)(zuo)假納入(ru)刑(xing)事制裁范圍(wei),強(qiang)力震懾了生態(tai)(tai)環(huan)(huan)境(jing)(jing)違法(fa)(fa)(fa)(fa)(fa)(fa)犯(fan)罪行為。目前,現行有效的(de)(de)(de)生態(tai)(tai)環(huan)(huan)保(bao)(bao)(bao)(bao)類法(fa)(fa)(fa)(fa)(fa)(fa)律(lv)有30余部(bu)(bu)、行政法(fa)(fa)(fa)(fa)(fa)(fa)規100多件、地方性法(fa)(fa)(fa)(fa)(fa)(fa)規1000余件,初步構(gou)建(jian)起(qi)以環(huan)(huan)境(jing)(jing)保(bao)(bao)(bao)(bao)護(hu)(hu)(hu)(hu)法(fa)(fa)(fa)(fa)(fa)(fa)為統(tong)領(ling),涵蓋(gai)水、氣、聲(sheng)、渣(zha)等(deng)各(ge)類污(wu)(wu)染(ran)要素和山水林田湖草沙等(deng)各(ge)類自然生態(tai)(tai)系統(tong),務實(shi)管(guan)用、嚴格嚴密(mi)的(de)(de)(de)生態(tai)(tai)環(huan)(huan)境(jing)(jing)保(bao)(bao)(bao)(bao)護(hu)(hu)(hu)(hu)法(fa)(fa)(fa)(fa)(fa)(fa)律(lv)體(ti)(ti)系。

二(er)、法律實施進展(zhan)及成效

環(huan)境(jing)保護法修訂實(shi)施以來,各地(di)各部(bu)門(men)深(shen)入學習貫(guan)徹習近平生(sheng)態(tai)(tai)文明思想(xiang),堅決(jue)(jue)落實(shi)黨中央關于生(sheng)態(tai)(tai)文明建設(she)決(jue)(jue)策部(bu)署,認真貫(guan)徹實(shi)施環(huan)境(jing)保護法律(lv)法規,依(yi)法治理污染、保護和改善生(sheng)態(tai)(tai)環(huan)境(jing)取得顯著成效。

(一(yi))環境保護法定(ding)職責不斷落實

落(luo)實法律第26條關于環(huan)境(jing)(jing)(jing)保(bao)護(hu)目(mu)標(biao)責(ze)任制(zhi)(zhi)和(he)(he)考(kao)核評(ping)價(jia)制(zhi)(zhi)度的規定,制(zhi)(zhi)定《中(zhong)央和(he)(he)國(guo)家機關有關部(bu)門生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)環(huan)境(jing)(jing)(jing)保(bao)護(hu)責(ze)任清單》《生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)文明(ming)(ming)建(jian)設(she)目(mu)標(biao)評(ping)價(jia)考(kao)核辦法》,明(ming)(ming)確了中(zhong)央和(he)(he)國(guo)家機關有關部(bu)門生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)環(huan)境(jing)(jing)(jing)保(bao)護(hu)責(ze)任,壓(ya)實了政(zheng)府主體(ti)責(ze)任。各地嚴格落(luo)實生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)環(huan)境(jing)(jing)(jing)保(bao)護(hu)“黨(dang)政(zheng)同責(ze)、一崗雙責(ze)”責(ze)任制(zhi)(zhi),普(pu)遍成(cheng)立了黨(dang)委、政(zheng)府主要領導(dao)負責(ze)的生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)文明(ming)(ming)建(jian)設(she)領導(dao)小(xiao)組、生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)環(huan)境(jing)(jing)(jing)保(bao)護(hu)委員會,制(zhi)(zhi)定責(ze)任清單,統籌協調(diao)處(chu)理重大問(wen)題。江西、貴州(zhou)、西藏等地出臺(tai)生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)文明(ming)(ming)建(jian)設(she)促進條例,強(qiang)化生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)文明(ming)(ming)建(jian)設(she)考(kao)核評(ping)價(jia)的剛性約束。

國(guo)務(wu)院及地(di)(di)方政(zheng)府認真履行(xing)法定(ding)職責。落(luo)(luo)實(shi)(shi)法律(lv)第(di)27條規(gui)定(ding),國(guo)務(wu)院每年(nian)向全國(guo)人大(da)(da)(da)常委會報告(gao)環(huan)境(jing)(jing)(jing)狀況(kuang)和(he)環(huan)境(jing)(jing)(jing)保(bao)(bao)護(hu)目(mu)標完(wan)成情況(kuang)。縣(xian)級(ji)(ji)以上人民政(zheng)府認真實(shi)(shi)施環(huan)境(jing)(jing)(jing)報告(gao)制度(du)(du)(du),依法接受人大(da)(da)(da)監督。浙江建立(li)省(sheng)市縣(xian)鄉四(si)級(ji)(ji)政(zheng)府環(huan)境(jing)(jing)(jing)報告(gao)制度(du)(du)(du),云(yun)南(nan)省(sheng)將環(huan)境(jing)(jing)(jing)報告(gao)完(wan)成情況(kuang)納入(ru)對地(di)(di)方和(he)部(bu)門考(kao)核(he)內容。落(luo)(luo)實(shi)(shi)法律(lv)第(di)7條規(gui)定(ding),加(jia)強生(sheng)態(tai)(tai)環(huan)境(jing)(jing)(jing)保(bao)(bao)護(hu)與污染治(zhi)理(li)科技研(yan)發,環(huan)保(bao)(bao)技術總體水平大(da)(da)(da)幅(fu)提升,為科學(xue)(xue)治(zhi)污、科學(xue)(xue)修(xiu)復(fu)提供了(le)有力支撐。落(luo)(luo)實(shi)(shi)法律(lv)第(di)8條規(gui)定(ding),各(ge)級(ji)(ji)財政(zheng)部(bu)門將生(sheng)態(tai)(tai)環(huan)保(bao)(bao)放(fang)在(zai)重要位(wei)置優先保(bao)(bao)障,財政(zheng)資金(jin)投入(ru)力度(du)(du)(du)不斷加(jia)大(da)(da)(da)。黨的(de)十(shi)九大(da)(da)(da)以來,中央財政(zheng)累計安排生(sheng)態(tai)(tai)環(huan)保(bao)(bao)相(xiang)關(guan)資金(jin)20272億元,年(nian)均增長5.12%,山西、湖南(nan)、廣東(dong)、四(si)川、寧夏等(deng)地(di)(di)持(chi)續加(jia)大(da)(da)(da)投入(ru)力度(du)(du)(du),多(duo)地(di)(di)生(sheng)態(tai)(tai)環(huan)保(bao)(bao)資金(jin)投入(ru)增幅(fu)高(gao)于一(yi)般公(gong)共(gong)預算收(shou)入(ru)增幅(fu)。各(ge)地(di)(di)各(ge)部(bu)門借助“六五”環(huan)境(jing)(jing)(jing)日等(deng)開展(zhan)形(xing)式多(duo)樣的(de)宣傳(chuan)活(huo)動(dong)(dong),積極推動(dong)(dong)生(sheng)態(tai)(tai)環(huan)境(jing)(jing)(jing)保(bao)(bao)護(hu)法律(lv)法規(gui)和(he)環(huan)保(bao)(bao)知(zhi)識進機(ji)關(guan)、進學(xue)(xue)校、進社區、進企業、進家庭,營造保(bao)(bao)護(hu)生(sheng)態(tai)(tai)環(huan)境(jing)(jing)(jing)良好氛圍。

(二)依法推(tui)動經濟社會(hui)發(fa)展全(quan)面綠色(se)轉型

法律第4條(tiao)(tiao)明確“國(guo)家(jia)采取有利(li)于節(jie)約(yue)和(he)循(xun)環(huan)(huan)利(li)用資(zi)(zi)源、保護(hu)和(he)改善環(huan)(huan)境、促(cu)進人與(yu)自然和(he)諧的(de)經濟、技(ji)術政策和(he)措施,使(shi)經濟社會發(fa)展(zhan)與(yu)環(huan)(huan)境保護(hu)相協(xie)調”。各(ge)地各(ge)部門落(luo)實法律規(gui)(gui)(gui)定(ding),積極(ji)推(tui)動(dong)經濟社會發(fa)展(zhan)全(quan)(quan)面綠色轉型。落(luo)實法律第13條(tiao)(tiao)規(gui)(gui)(gui)定(ding),國(guo)務院出臺(tai)了《“十(shi)四五”生(sheng)(sheng)態(tai)環(huan)(huan)境保護(hu)規(gui)(gui)(gui)劃(hua)》,福建(jian)、湖北、海南等地出臺(tai)生(sheng)(sheng)態(tai)省建(jian)設(she)規(gui)(gui)(gui)劃(hua),推(tui)動(dong)生(sheng)(sheng)態(tai)環(huan)(huan)境保護(hu)融入(ru)經濟社會發(fa)展(zhan)各(ge)方面、全(quan)(quan)過程。落(luo)實法律第46條(tiao)(tiao)規(gui)(gui)(gui)定(ding),加(jia)快(kuai)淘(tao)汰(tai)落(luo)后產(chan)(chan)能,堅決遏制高(gao)耗能、高(gao)排(pai)放(fang)、低水平項目(mu)盲目(mu)發(fa)展(zhan)。落(luo)實法律第40條(tiao)(tiao)規(gui)(gui)(gui)定(ding),采取有力措施推(tui)廣清潔(jie)能源生(sheng)(sheng)產(chan)(chan)使(shi)用,促(cu)進資(zi)(zi)源節(jie)約(yue)集約(yue)循(xun)環(huan)(huan)利(li)用。落(luo)實法律第21條(tiao)(tiao)要求,鼓勵(li)和(he)支持各(ge)類環(huan)(huan)保產(chan)(chan)業(ye)發(fa)展(zhan),2021年節(jie)能環(huan)(huan)保產(chan)(chan)業(ye)總產(chan)(chan)值達到8.4萬億元,年均增速(su)10%以上。落(luo)實法律第36條(tiao)(tiao)規(gui)(gui)(gui)定(ding),節(jie)能環(huan)(huan)保產(chan)(chan)品占同類產(chan)(chan)品政府采購規(gui)(gui)(gui)模比例超85%。

(三)生態(tai)環保(bao)配套(tao)法規不斷健全

國務院(yuan)(yuan)及有(you)關(guan)(guan)部(bu)(bu)門(men)加強行(xing)政法(fa)(fa)(fa)(fa)規(gui)(gui)規(gui)(gui)章制(zhi)(zhi)定(ding),印(yin)發(fa)排污(wu)許可管理條(tiao)例(li)等(deng)(deng)法(fa)(fa)(fa)(fa)規(gui)(gui),生(sheng)(sheng)態(tai)(tai)(tai)環(huan)境(jing)部(bu)(bu)在法(fa)(fa)(fa)(fa)律實(shi)施當(dang)年(nian)印(yin)發(fa)按日(ri)計罰、查封(feng)扣押、限產停產、信息公(gong)開等(deng)(deng)配套辦法(fa)(fa)(fa)(fa)。最(zui)高人民(min)法(fa)(fa)(fa)(fa)院(yuan)(yuan)、最(zui)高人民(min)檢(jian)察院(yuan)(yuan)等(deng)(deng)單位制(zhi)(zhi)定(ding)環(huan)境(jing)污(wu)染(ran)犯罪、公(gong)益訴訟和生(sheng)(sheng)態(tai)(tai)(tai)環(huan)境(jing)侵權(quan)責任糾紛(fen)等(deng)(deng)20余(yu)件(jian)(jian)(jian)(jian)(jian)司(si)法(fa)(fa)(fa)(fa)解(jie)釋(shi),有(you)力推動法(fa)(fa)(fa)(fa)律制(zhi)(zhi)度落(luo)實(shi)落(luo)細。各(ge)(ge)地(di)(di)人大(da)及其常委會將生(sheng)(sheng)態(tai)(tai)(tai)環(huan)保(bao)(bao)作為重(zhong)點領域(yu),加快立(li)法(fa)(fa)(fa)(fa)步伐。天津市率先出(chu)(chu)臺生(sheng)(sheng)態(tai)(tai)(tai)環(huan)境(jing)保(bao)(bao)護(hu)條(tiao)例(li),江蘇制(zhi)(zhi)修(xiu)訂(ding)生(sheng)(sheng)態(tai)(tai)(tai)環(huan)境(jing)保(bao)(bao)護(hu)法(fa)(fa)(fa)(fa)規(gui)(gui)72件(jian)(jian)(jian)(jian)(jian),占比近80%。不少地(di)(di)方(fang)(fang)出(chu)(chu)臺一批解(jie)決(jue)實(shi)際問題的(de)“小快靈(ling)”立(li)法(fa)(fa)(fa)(fa),吉(ji)林(lin)、黑龍江制(zhi)(zhi)定(ding)黑土地(di)(di)保(bao)(bao)護(hu)利(li)用(yong)條(tiao)例(li),依法(fa)(fa)(fa)(fa)保(bao)(bao)護(hu)好、利(li)用(yong)好“耕(geng)地(di)(di)中(zhong)的(de)大(da)熊貓(mao)”。河北(bei)制(zhi)(zhi)定(ding)白(bai)洋淀生(sheng)(sheng)態(tai)(tai)(tai)保(bao)(bao)護(hu)條(tiao)例(li),內蒙古制(zhi)(zhi)定(ding)胡楊林(lin)保(bao)(bao)護(hu)條(tiao)例(li)。京津冀、長三角(jiao)加強區域(yu)協同(tong)立(li)法(fa)(fa)(fa)(fa),云貴川(chuan)開展(zhan)赤(chi)水河流(liu)域(yu)保(bao)(bao)護(hu)共同(tong)立(li)法(fa)(fa)(fa)(fa)。同(tong)時,加強生(sheng)(sheng)態(tai)(tai)(tai)環(huan)保(bao)(bao)領域(yu)規(gui)(gui)范(fan)性(xing)文件(jian)(jian)(jian)(jian)(jian)清理。2018年(nian)到(dao)2019年(nian),全國人大(da)常委會法(fa)(fa)(fa)(fa)制(zhi)(zhi)工作委員會貫徹落(luo)實(shi)相關(guan)(guan)決(jue)議,連續兩年(nian)開展(zhan)生(sheng)(sheng)態(tai)(tai)(tai)環(huan)保(bao)(bao)領域(yu)規(gui)(gui)范(fan)性(xing)文件(jian)(jian)(jian)(jian)(jian)集中(zhong)清理工作,督促各(ge)(ge)地(di)(di)修(xiu)改(gai)814件(jian)(jian)(jian)(jian)(jian)、廢止(zhi)127件(jian)(jian)(jian)(jian)(jian)地(di)(di)方(fang)(fang)性(xing)法(fa)(fa)(fa)(fa)規(gui)(gui),推動制(zhi)(zhi)定(ding)機關(guan)(guan)及時修(xiu)改(gai)、廢止(zhi)或重(zhong)新制(zhi)(zhi)定(ding)37件(jian)(jian)(jian)(jian)(jian)部(bu)(bu)門(men)規(gui)(gui)章、456件(jian)(jian)(jian)(jian)(jian)地(di)(di)方(fang)(fang)政府規(gui)(gui)章、2件(jian)(jian)(jian)(jian)(jian)司(si)法(fa)(fa)(fa)(fa)解(jie)釋(shi)以及1.1萬余(yu)件(jian)(jian)(jian)(jian)(jian)各(ge)(ge)類規(gui)(gui)范(fan)性(xing)文件(jian)(jian)(jian)(jian)(jian)。

(四(si))環境保護主要法律(lv)制(zhi)度不斷落實

落實(shi)(shi)法律(lv)第(di)16條(tiao)(tiao)規(gui)(gui)定(ding)(ding),不斷(duan)完善標(biao)準(zhun)體(ti)系。“十三(san)五”期間共制(zhi)修訂國(guo)家(jia)生(sheng)態(tai)環(huan)(huan)(huan)境(jing)(jing)標(biao)準(zhun)673項(xiang)(xiang),增長幅度(du)(du)為歷次(ci)最(zui)高(gao)。截至2021年(nian)底,國(guo)家(jia)生(sheng)態(tai)環(huan)(huan)(huan)境(jing)(jing)標(biao)準(zhun)總(zong)數(shu)達到2243項(xiang)(xiang),其中強制(zhi)性標(biao)準(zhun)201項(xiang)(xiang)。依法備案的(de)地(di)(di)方生(sheng)態(tai)環(huan)(huan)(huan)境(jing)(jing)標(biao)準(zhun)總(zong)數(shu)達到336項(xiang)(xiang)。落實(shi)(shi)法律(lv)第(di)17條(tiao)(tiao)規(gui)(gui)定(ding)(ding),建(jian)立(li)健(jian)全(quan)(quan)環(huan)(huan)(huan)境(jing)(jing)監(jian)測(ce)制(zhi)度(du)(du)。完成(cheng)國(guo)家(jia)環(huan)(huan)(huan)境(jing)(jing)質量監(jian)測(ce)事權上收,基(ji)本完成(cheng)省以下環(huan)(huan)(huan)保監(jian)測(ce)機(ji)構(gou)垂直管理改(gai)革(ge),實(shi)(shi)現了從“考核誰(shui)、誰(shui)監(jian)測(ce)”向“誰(shui)考核、誰(shui)監(jian)測(ce)”的(de)轉變。強化重點排污單位自行監(jian)測(ce)責任,形成(cheng)覆蓋全(quan)(quan)國(guo)近(jin)2萬(wan)家(jia)重點排污單位的(de)自動監(jian)控網絡。落實(shi)(shi)法律(lv)第(di)20條(tiao)(tiao)規(gui)(gui)定(ding)(ding),區(qu)域(yu)流(liu)域(yu)聯合(he)防治機(ji)制(zhi)有(you)序(xu)推進,全(quan)(quan)國(guo)23個(ge)省份建(jian)立(li)12個(ge)涉(she)危險廢物(wu)的(de)跨區(qu)域(yu)聯防聯控機(ji)制(zhi)或協(xie)議(yi)。落實(shi)(shi)法律(lv)第(di)45條(tiao)(tiao)規(gui)(gui)定(ding)(ding),全(quan)(quan)面實(shi)(shi)行排污許可制(zhi)度(du)(du),全(quan)(quan)國(guo)334.04萬(wan)個(ge)固(gu)定(ding)(ding)污染源全(quan)(quan)部納入排污許可管理,實(shi)(shi)現大氣、水、固(gu)體(ti)廢物(wu)等多污染物(wu)協(xie)同治理。堅持損害擔責原則,建(jian)立(li)健(jian)全(quan)(quan)生(sheng)態(tai)環(huan)(huan)(huan)境(jing)(jing)損害賠(pei)償(chang)制(zhi)度(du)(du)。2018年(nian)到2021年(nian),各地(di)(di)生(sheng)態(tai)環(huan)(huan)(huan)境(jing)(jing)損害賠(pei)償(chang)案件(jian)(jian)1.13萬(wan)件(jian)(jian),賠(pei)償(chang)金(jin)額超過117億元。落實(shi)(shi)法律(lv)第(di)53、54條(tiao)(tiao)規(gui)(gui)定(ding)(ding),生(sheng)態(tai)環(huan)(huan)(huan)境(jing)(jing)部及時、準(zhun)確(que)、全(quan)(quan)面公開(kai)環(huan)(huan)(huan)境(jing)(jing)質量等生(sheng)態(tai)環(huan)(huan)(huan)境(jing)(jing)信(xin)息,各地(di)(di)積極(ji)探索信(xin)息公開(kai)方式(shi),公眾參與有(you)序(xu)推進。落實(shi)(shi)法律(lv)第(di)57條(tiao)(tiao)規(gui)(gui)定(ding)(ding),建(jian)立(li)健(jian)全(quan)(quan)舉報(bao)、聽證等制(zhi)度(du)(du)措施,河南、陜西(xi)、甘肅等地(di)(di)建(jian)立(li)有(you)獎(jiang)舉報(bao)制(zhi)度(du)(du),“十三(san)五”以來全(quan)(quan)國(guo)接收群眾舉報(bao)326萬(wan)多件(jian)(jian)。

(五)用法治(zhi)力(li)量助(zhu)力(li)打好(hao)污染(ran)防治(zhi)攻堅戰

落實法(fa)律第四章規(gui)定(ding),加強(qiang)大氣(qi)(qi)、水、土壤、固體(ti)廢物污(wu)染防治,依法(fa)打好污(wu)染防治攻堅戰。加強(qiang)重點區域(yu)、重點行業大氣(qi)(qi)污(wu)染防治,2021年京津冀及(ji)周邊地區、長三(san)角、汾渭平原細顆粒物(PM2.5)平均濃度分(fen)(fen)別比2015年下降46.2%、39.2%、25%,北京市環境(jing)空氣(qi)質量6項指標全(quan)面達標。加(jia)強(qiang)(qiang)飲用(yong)水(shui)安全(quan)保障和重點流域水(shui)污染防治(zhi)(zhi),開展(zhan)入河排污口排查(cha)整(zheng)治(zhi)(zhi)等專項行動。全(quan)國(guo)(guo)地級及以(yi)上城(cheng)市集(ji)中(zhong)式(shi)飲用(yong)水(shui)水(shui)源(yuan)水(shui)質達到(dao)或優于Ⅲ類比例(li)為94.2%,全(quan)國(guo)(guo)污水(shui)處(chu)理規模達2.3億(yi)立方米,形成全(quan)世(shi)界最大的污水(shui)處(chu)理能力。強(qiang)(qiang)化重點地區農(nong)(nong)用(yong)地和建設用(yong)地土壤(rang)污染防治(zhi)(zhi),實施化肥農(nong)(nong)藥使用(yong)量零增(zeng)長行動,畜(chu)禽糞污綜(zong)(zong)合利用(yong)率超過76%,秸稈綜(zong)(zong)合利用(yong)率達到(dao)87.6%,農(nong)(nong)膜回收率穩定在80%以(yi)上。加(jia)強(qiang)(qiang)固體廢(fei)(fei)物(wu)(wu)(wu)污染防治(zhi)(zhi),生活垃圾(ji)(ji)分(fen)(fen)類進展(zhan)明顯(xian),危(wei)險廢(fei)(fei)物(wu)(wu)(wu)監管(guan)和處(chu)置(zhi)能力不(bu)斷加(jia)強(qiang)(qiang),醫療廢(fei)(fei)物(wu)(wu)(wu)收集(ji)處(chu)置(zhi)能力大幅提升(sheng)。截(jie)至2021年底(di),全(quan)國(guo)(guo)297個地級以(yi)上城(cheng)市全(quan)面啟動生活垃圾(ji)(ji)分(fen)(fen)類工(gong)作,居民(min)小區垃圾(ji)(ji)分(fen)(fen)類平均覆蓋(gai)率達到(dao)77.1%。持續開展(zhan)農(nong)(nong)村(cun)人居環境(jing)綜(zong)(zong)合整(zheng)治(zhi)(zhi),農(nong)(nong)村(cun)人居環境(jing)明顯(xian)改善。印發(fa)《新污染物(wu)(wu)(wu)治(zhi)(zhi)理行動方案》,加(jia)強(qiang)(qiang)新污染物(wu)(wu)(wu)治(zhi)(zhi)理。

(六)持續加強生(sheng)態(tai)保護和修復

落實法(fa)律(lv)第29條(tiao)規(gui)定,劃(hua)定并(bing)嚴守生(sheng)(sheng)態(tai)(tai)保(bao)(bao)護(hu)(hu)紅(hong)線(xian)(xian)。初步完(wan)成生(sheng)(sheng)態(tai)(tai)保(bao)(bao)護(hu)(hu)紅(hong)線(xian)(xian)劃(hua)定,涵蓋了全國(guo)大部分陸地生(sheng)(sheng)態(tai)(tai)系(xi)(xi)統(tong)和典型海洋生(sheng)(sheng)態(tai)(tai)系(xi)(xi)統(tong),對生(sheng)(sheng)態(tai)(tai)功能極重要、生(sheng)(sheng)態(tai)(tai)極脆弱(ruo)區域(yu)等(deng)進行嚴格保(bao)(bao)護(hu)(hu)。青海扎實推進國(guo)家公園(yuan)示(shi)范(fan)省建(jian)設,在(zai)全國(guo)率先(xian)完(wan)成自(zi)然保(bao)(bao)護(hu)(hu)地調查評估。落實法(fa)律(lv)第30條(tiao)規(gui)定,加大生(sheng)(sheng)態(tai)(tai)保(bao)(bao)護(hu)(hu)修(xiu)復力度,自(zi)然生(sheng)(sheng)態(tai)(tai)系(xi)(xi)統(tong)總體穩定向好。實施生(sheng)(sheng)物(wu)多樣性(xing)保(bao)(bao)護(hu)(hu)重大工程(cheng),74%的國(guo)家重點保(bao)(bao)護(hu)(hu)野生(sheng)(sheng)動植物(wu)物(wu)種得到有效保(bao)(bao)護(hu)(hu)。落實法(fa)律(lv)第31條(tiao)規(gui)定,深(shen)入實施生(sheng)(sheng)態(tai)(tai)保(bao)(bao)護(hu)(hu)補償(chang)制度。福建(jian)率先(xian)在(zai)全省范(fan)圍開展(zhan)流域(yu)生(sheng)(sheng)態(tai)(tai)保(bao)(bao)護(hu)(hu)補償(chang),安徽和浙江在(zai)新安江流域(yu)開展(zhan)橫(heng)向生(sheng)(sheng)態(tai)(tai)保(bao)(bao)護(hu)(hu)補償(chang),全國(guo)18個省份在(zai)13個流域(yu)(河(he)段(duan))建(jian)立了跨省流域(yu)上下游橫(heng)向生(sheng)(sheng)態(tai)(tai)保(bao)(bao)護(hu)(hu)補償(chang)機制。

(七)生(sheng)態環境執法(fa)(fa)監(jian)管更加嚴格,法(fa)(fa)治(zhi)威(wei)力有(you)效彰顯(xian)

嚴(yan)格落(luo)實法(fa)律第25條(tiao)(tiao)、59條(tiao)(tiao)、60條(tiao)(tiao)規定,用足(zu)用好法(fa)律賦予的查封扣押、限產(chan)停產(chan)、按日計(ji)(ji)罰、行(xing)政拘留等(deng)執法(fa)手(shou)段,依法(fa)嚴(yan)懲重處(chu)環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)違法(fa)行(xing)為,讓法(fa)律“長出牙(ya)齒”,惡意環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)違法(fa)勢(shi)頭得到明顯遏制(zhi)。2015年(nian)(nian)至(zhi)2021年(nian)(nian),全(quan)(quan)國各級生態(tai)(tai)環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)主管部(bu)門(men)(men)累計(ji)(ji)下達(da)環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)行(xing)政處(chu)罰決定書106.34萬(wan)(wan)份,罰沒(mei)款(kuan)數(shu)額總計(ji)(ji)695.50億(yi)元(yuan)。生態(tai)(tai)環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)部(bu)等(deng)7個部(bu)門(men)(men)連(lian)(lian)續(xu)5年(nian)(nian)開展(zhan)“綠盾”專(zhuan)(zhuan)(zhuan)項(xiang)(xiang)行(xing)動,加(jia)(jia)(jia)強(qiang)對自然保(bao)護地(di)監(jian)督管理(li)。公(gong)(gong)安(an)部(bu)加(jia)(jia)(jia)強(qiang)專(zhuan)(zhuan)(zhuan)業警種建設,連(lian)(lian)續(xu)開展(zhan)“昆侖”等(deng)系(xi)列專(zhuan)(zhuan)(zhuan)項(xiang)(xiang)行(xing)動。檢(jian)察機關(guan)加(jia)(jia)(jia)大對破壞環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)資(zi)源犯(fan)(fan)(fan)罪(zui)行(xing)為的打擊(ji)力度。2015年(nian)(nian)至(zhi)2021年(nian)(nian),全(quan)(quan)國檢(jian)察機關(guan)共(gong)(gong)(gong)對破壞環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)資(zi)源類(lei)犯(fan)(fan)(fan)罪(zui)案(an)(an)件(jian)(jian)提起(qi)公(gong)(gong)訴17.5萬(wan)(wan)件(jian)(jian)28.4萬(wan)(wan)人(ren)。2017年(nian)(nian)7月以來,立(li)案(an)(an)辦理(li)生態(tai)(tai)環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)和資(zi)源保(bao)護領域公(gong)(gong)益訴訟案(an)(an)件(jian)(jian)近30萬(wan)(wan)件(jian)(jian)。全(quan)(quan)面(mian)推進(jin)生態(tai)(tai)環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)司法(fa)保(bao)護專(zhuan)(zhuan)(zhuan)門(men)(men)化建設,構建環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)資(zi)源審(shen)(shen)判(pan)組織(zhi)體系(xi),生態(tai)(tai)環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)司法(fa)保(bao)障更加(jia)(jia)(jia)有(you)力。截至(zhi)2021年(nian)(nian)底,全(quan)(quan)國法(fa)院(yuan)共(gong)(gong)(gong)設立(li)2426個環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)資(zi)源審(shen)(shen)判(pan)組織(zhi)。2015年(nian)(nian)至(zhi)2021年(nian)(nian),全(quan)(quan)國法(fa)院(yuan)共(gong)(gong)(gong)審(shen)(shen)理(li)一審(shen)(shen)環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)資(zi)源案(an)(an)件(jian)(jian)97.7萬(wan)(wan)余件(jian)(jian)。各地(di)推動建立(li)聯席(xi)會議、重大案(an)(an)件(jian)(jian)會商督辦、執法(fa)聯動、信(xin)息共(gong)(gong)(gong)享(xiang)等(deng)行(xing)政執法(fa)與刑事司法(fa)銜接(jie)機制(zhi),重慶設立(li)公(gong)(gong)安(an)、檢(jian)察機關(guan)派駐生態(tai)(tai)環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)部(bu)門(men)(men)聯絡機構。生態(tai)(tai)環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)部(bu)、最高人(ren)民檢(jian)察院(yuan)、公(gong)(gong)安(an)部(bu)連(lian)(lian)續(xu)三年(nian)(nian)開展(zhan)深入打擊(ji)危(wei)險廢物環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)違法(fa)犯(fan)(fan)(fan)罪(zui)和重點排(pai)污單位(wei)自動監(jian)測數(shu)據(ju)弄(nong)虛(xu)作(zuo)假(jia)違法(fa)犯(fan)(fan)(fan)罪(zui)專(zhuan)(zhuan)(zhuan)項(xiang)(xiang)行(xing)動,保(bao)持(chi)打擊(ji)環(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)違法(fa)犯(fan)(fan)(fan)罪(zui)高壓(ya)態(tai)(tai)勢(shi)。

三、存在的(de)主(zhu)要問題

在(zai)環(huan)境(jing)保(bao)護(hu)法實施(shi)取(qu)得積極成效的(de)(de)同時(shi),也要(yao)看到我國生(sheng)(sheng)態(tai)環(huan)境(jing)保(bao)護(hu)結構性(xing)、根源性(xing)、趨勢性(xing)壓力尚未根本緩(huan)解,生(sheng)(sheng)態(tai)環(huan)境(jing)穩(wen)中(zhong)向好的(de)(de)基礎還不穩(wen)固,法律實施(shi)不到位(wei)的(de)(de)問題依然存在(zai),生(sheng)(sheng)態(tai)環(huan)境(jing)質(zhi)量(liang)同人民群眾對美好生(sheng)(sheng)活(huo)的(de)(de)期(qi)盼相(xiang)比(bi),同建設(she)美麗中(zhong)國的(de)(de)目標相(xiang)比(bi)還有一定差距。

(一)法定責(ze)任(ren)有(you)待進一步落實

地(di)方(fang)政府(fu)責任需進一步落實。法(fa)律第6條規定地(di)方(fang)各級人民(min)政府(fu)應當(dang)對本行政區(qu)域的環境(jing)質(zhi)量(liang)負責,但有(you)的地(di)方(fang)環境(jing)質(zhi)量(liang)不(bu)(bu)(bu)升(sheng)反降。2022年(nian)第一季度(du),長三角地(di)區(qu)、汾(fen)渭(wei)平原優(you)良(liang)天數比率(lv)分別同比下降5.2個百(bai)分點(dian)和7.8個百(bai)分點(dian)。中央生態環保督察發現,有(you)的地(di)方(fang)河流重(zhong)度(du)污(wu)染長期(qi)得(de)不(bu)(bu)(bu)到解決,一些(xie)水體(ti)返黑返臭,有(you)的工業園(yuan)區(qu)環境(jing)問題突出。有(you)的地(di)方(fang)落實法(fa)律第26條規定不(bu)(bu)(bu)到位,考(kao)(kao)核(he)評價體(ti)系不(bu)(bu)(bu)完善,考(kao)(kao)核(he)制(zhi)度(du)執(zhi)行不(bu)(bu)(bu)夠嚴(yan)格,考(kao)(kao)核(he)結果沒有(you)向(xiang)社會公開。有(you)些(xie)地(di)方(fang)政府(fu)未按(an)照法(fa)律第28條規定制(zhi)定限(xian)期(qi)達標規劃。

有的(de)部(bu)門(men)落實環(huan)(huan)保(bao)(bao)責(ze)任(ren)有差距。部(bu)分地方部(bu)門(men)生態環(huan)(huan)保(bao)(bao)責(ze)任(ren)劃分不夠清晰,在(zai)落實“管發展、管生產、管行業必須(xu)管環(huan)(huan)保(bao)(bao)”責(ze)任(ren)上還(huan)存(cun)在(zai)不平衡不充分的(de)現象,違規審批不符合(he)(he)國家要求(qiu)的(de)“兩高”項目。有的(de)地方部(bu)門(men)監管不嚴(yan),存(cun)在(zai)交(jiao)通建設領域生態破壞(huai)和(he)環(huan)(huan)境違法問題。地方反映,在(zai)統(tong)籌推進山水林(lin)田湖草沙一體化保(bao)(bao)護和(he)系統(tong)治理方面,需(xu)進一步(bu)加強部(bu)門(men)間協同(tong)配(pei)合(he)(he)。

企業(ye)(ye)治(zhi)污(wu)(wu)責任落實不到位。有(you)的企業(ye)(ye)違反法(fa)(fa)律第41條(tiao)(tiao)規(gui)(gui)定,污(wu)(wu)染防治(zhi)設施尚未(wei)建成,主體工(gong)程就已投產(chan)使用(yong)(yong)。一(yi)些企業(ye)(ye)違反法(fa)(fa)律第42條(tiao)(tiao)規(gui)(gui)定,未(wei)安裝(zhuang)或不正常(chang)運行治(zhi)污(wu)(wu)設施,超標排放等(deng)違法(fa)(fa)問(wen)(wen)題較(jiao)為突出。部分企業(ye)(ye)違反法(fa)(fa)律第45條(tiao)(tiao)規(gui)(gui)定,存在無證排污(wu)(wu)、不依(yi)證排污(wu)(wu)等(deng)問(wen)(wen)題。有(you)的企業(ye)(ye)違反第46條(tiao)(tiao)規(gui)(gui)定,使用(yong)(yong)應(ying)(ying)淘汰(tai)的設備和產(chan)品。有(you)些企業(ye)(ye)未(wei)按照法(fa)(fa)律第47條(tiao)(tiao)規(gui)(gui)定制(zhi)定突發環境(jing)事(shi)件應(ying)(ying)急預案。

(二)部分法律制(zhi)度措施執(zhi)行(xing)不夠到位

環境(jing)(jing)監(jian)(jian)測(ce)(ce)(ce)制(zhi)度(du)有(you)(you)待進一(yi)步(bu)落(luo)實。檢查發(fa)現(xian),監(jian)(jian)測(ce)(ce)(ce)數據(ju)共享(xiang)機制(zhi)尚(shang)未(wei)建立。一(yi)些(xie)地方(fang)基層監(jian)(jian)測(ce)(ce)(ce)能力薄弱(ruo),自動(dong)監(jian)(jian)測(ce)(ce)(ce)覆蓋率不(bu)高(gao),有(you)(you)的(de)在線監(jian)(jian)測(ce)(ce)(ce)設備運(yun)行(xing)不(bu)正常,排(pai)(pai)污單位(wei)和(he)(he)監(jian)(jian)測(ce)(ce)(ce)機構數據(ju)造假問(wen)題時有(you)(you)發(fa)生。環境(jing)(jing)影響評(ping)(ping)價制(zhi)度(du)執行(xing)還不(bu)夠到位(wei)。有(you)(you)些(xie)規劃未(wei)開(kai)(kai)展(zhan)規劃環評(ping)(ping),存在“重程序輕落(luo)實”問(wen)題,有(you)(you)的(de)建設項(xiang)目未(wei)批(pi)先建、批(pi)建不(bu)符。信(xin)息(xi)公開(kai)(kai)制(zhi)度(du)有(you)(you)待進一(yi)步(bu)落(luo)實。評(ping)(ping)估(gu)顯示,一(yi)些(xie)地方(fang)環境(jing)(jing)信(xin)息(xi)內容(rong)不(bu)全面(mian)、公開(kai)(kai)不(bu)及時,有(you)(you)的(de)重點排(pai)(pai)污企業未(wei)依法(fa)公開(kai)(kai)環境(jing)(jing)信(xin)息(xi)或信(xin)息(xi)不(bu)完整。區域(yu)(yu)聯(lian)防(fang)(fang)聯(lian)控制(zhi)度(du)需深入落(luo)實。地方(fang)反映,區域(yu)(yu)聯(lian)防(fang)(fang)聯(lian)控在統(tong)一(yi)規劃、統(tong)一(yi)標準、統(tong)一(yi)防(fang)(fang)治(zhi)措施等方(fang)面(mian)協調(diao)(diao)不(bu)夠,跨(kua)區域(yu)(yu)的(de)大(da)江大(da)河大(da)湖在干支流、上(shang)下游、左右岸污染治(zhi)理和(he)(he)聯(lian)合執法(fa)司法(fa)等方(fang)面(mian)協調(diao)(diao)聯(lian)動(dong)不(bu)足。環境(jing)(jing)與健(jian)康監(jian)(jian)測(ce)(ce)(ce)、調(diao)(diao)查和(he)(he)風險評(ping)(ping)估(gu)制(zhi)度(du)尚(shang)未(wei)健(jian)全。

(三)污(wu)染防治還存在短板弱項(xiang)

法律(lv)第四章對防(fang)治(zhi)污(wu)(wu)(wu)(wu)(wu)染(ran)(ran)(ran)(ran)(ran)和(he)(he)其他公害作出(chu)規定,針(zhen)對廢(fei)氣(qi)、廢(fei)水(shui)、廢(fei)渣、農業面(mian)源污(wu)(wu)(wu)(wu)(wu)染(ran)(ran)(ran)(ran)(ran)、生(sheng)活(huo)垃(la)圾等(deng)污(wu)(wu)(wu)(wu)(wu)染(ran)(ran)(ran)(ran)(ran)防(fang)治(zhi)規定了具體措施(shi)。全(quan)國主要(yao)污(wu)(wu)(wu)(wu)(wu)染(ran)(ran)(ran)(ran)(ran)物(wu)(wu)排放總(zong)量仍(reng)處(chu)(chu)高(gao)(gao)位,部(bu)分(fen)地(di)(di)(di)(di)區(qu)環(huan)境問題(ti)較為突出(chu)。2021年(nian)(nian)(nian),全(quan)國有(you)(you)35.7%的城市(shi)空氣(qi)質量尚未達(da)標,一些(xie)行(xing)(xing)業和(he)(he)地(di)(di)(di)(di)區(qu)揮發性(xing)有(you)(you)機物(wu)(wu)污(wu)(wu)(wu)(wu)(wu)染(ran)(ran)(ran)(ran)(ran)治(zhi)理(li)不(bu)(bu)(bu)(bu)到位。2022年(nian)(nian)(nian)上(shang)半(ban)年(nian)(nian)(nian),全(quan)國地(di)(di)(di)(di)級以(yi)上(shang)城市(shi)臭氧(yang)平(ping)(ping)均濃度同比上(shang)升4.3%。法律(lv)第51條要(yao)求統籌城鄉建設(she)污(wu)(wu)(wu)(wu)(wu)水(shui)處(chu)(chu)理(li)設(she)施(shi)及配套管網。城市(shi)污(wu)(wu)(wu)(wu)(wu)水(shui)處(chu)(chu)理(li)設(she)施(shi)運(yun)行(xing)(xing)和(he)(he)管網建設(she)滯(zhi)后是水(shui)污(wu)(wu)(wu)(wu)(wu)染(ran)(ran)(ran)(ran)(ran)治(zhi)理(li)的突出(chu)短板,一些(xie)地(di)(di)(di)(di)方污(wu)(wu)(wu)(wu)(wu)水(shui)收集能(neng)力(li)不(bu)(bu)(bu)(bu)足、處(chu)(chu)理(li)設(she)施(shi)運(yun)行(xing)(xing)不(bu)(bu)(bu)(bu)穩定、污(wu)(wu)(wu)(wu)(wu)泥處(chu)(chu)理(li)不(bu)(bu)(bu)(bu)規范(fan)等(deng)問題(ti)較為突出(chu)。2021年(nian)(nian)(nian)全(quan)國地(di)(di)(di)(di)下水(shui)Ⅴ類比例(li)(li)達(da)到21.6%,部(bu)分(fen)重(zhong)(zhong)點湖(hu)泊富營(ying)養化(hua),近(jin)岸海域劣四類海域面(mian)積比例(li)(li)占9.6%。第二次全(quan)國污(wu)(wu)(wu)(wu)(wu)染(ran)(ran)(ran)(ran)(ran)源普查結(jie)果顯示,農業源化(hua)學需氧(yang)量、總(zong)氮(dan)、總(zong)磷占比較高(gao)(gao),農業源已經成為影響水(shui)體質量的重(zhong)(zhong)要(yao)因(yin)素之一。農村生(sheng)活(huo)污(wu)(wu)(wu)(wu)(wu)水(shui)治(zhi)理(li)率較低(di),部(bu)分(fen)地(di)(di)(di)(di)區(qu)化(hua)肥(fei)農藥科學合理(li)施(shi)用(yong)(yong)水(shui)平(ping)(ping)和(he)(he)畜禽養殖污(wu)(wu)(wu)(wu)(wu)染(ran)(ran)(ran)(ran)(ran)防(fang)治(zhi)水(shui)平(ping)(ping)有(you)(you)待(dai)(dai)提高(gao)(gao)。有(you)(you)的地(di)(di)(di)(di)塊土(tu)壤污(wu)(wu)(wu)(wu)(wu)染(ran)(ran)(ran)(ran)(ran)風險(xian)管控不(bu)(bu)(bu)(bu)到位,多數(shu)縣城生(sheng)活(huo)垃(la)圾處(chu)(chu)理(li)以(yi)填埋為主,垃(la)圾焚(fen)燒比率有(you)(you)待(dai)(dai)提高(gao)(gao)。部(bu)分(fen)垃(la)圾填埋場運(yun)行(xing)(xing)不(bu)(bu)(bu)(bu)規范(fan),滲濾液處(chu)(chu)理(li)不(bu)(bu)(bu)(bu)到位。一些(xie)地(di)(di)(di)(di)區(qu)生(sheng)活(huo)垃(la)圾分(fen)類收集和(he)(he)運(yun)輸(shu)設(she)施(shi)不(bu)(bu)(bu)(bu)足,廚余垃(la)圾處(chu)(chu)理(li)產品出(chu)路不(bu)(bu)(bu)(bu)暢。新污(wu)(wu)(wu)(wu)(wu)染(ran)(ran)(ran)(ran)(ran)物(wu)(wu)治(zhi)理(li)仍(reng)是薄弱環(huan)節。生(sheng)態環(huan)保(bao)投入(ru)以(yi)財(cai)政(zheng)為主,污(wu)(wu)(wu)(wu)(wu)染(ran)(ran)(ran)(ran)(ran)者付(fu)費機制尚不(bu)(bu)(bu)(bu)完善,社會資本參與(yu)不(bu)(bu)(bu)(bu)足,不(bu)(bu)(bu)(bu)少地(di)(di)(di)(di)方城市(shi)基礎設(she)施(shi)建設(she)運(yun)營(ying)存在資金(jin)缺口(kou)。科技(ji)支(zhi)撐能(neng)力(li)需進一步加強(qiang)。檢查發現,生(sheng)態環(huan)保(bao)科技(ji)支(zhi)撐、成果轉化(hua)和(he)(he)推廣應用(yong)(yong)機制不(bu)(bu)(bu)(bu)完善,土(tu)壤污(wu)(wu)(wu)(wu)(wu)染(ran)(ran)(ran)(ran)(ran)防(fang)治(zhi)、固廢(fei)綜合利用(yong)(yong)、新污(wu)(wu)(wu)(wu)(wu)染(ran)(ran)(ran)(ran)(ran)物(wu)(wu)治(zhi)理(li)等(deng)領域技(ji)術支(zhi)撐不(bu)(bu)(bu)(bu)足。

(四)生態保(bao)護(hu)和修復亟待加強

生(sheng)(sheng)(sheng)態(tai)保護(hu)紅線(xian)監管力度需(xu)進一步(bu)加(jia)(jia)(jia)大。部(bu)(bu)分(fen)國家級自然(ran)保護(hu)區(qu)(qu)(qu)內存在工礦、旅游、養殖、房(fang)地(di)(di)產等違(wei)規項目,個別地(di)(di)方(fang)(fang)(fang)(fang)為了給開發(fa)讓路,頻(pin)繁調整自然(ran)保護(hu)區(qu)(qu)(qu)范(fan)圍。生(sheng)(sheng)(sheng)態(tai)系統受(shou)損(sun)退(tui)化(hua)(hua)問題(ti)不容忽視。一些(xie)地(di)(di)方(fang)(fang)(fang)(fang)在開發(fa)利用自然(ran)資源時沒有(you)依法制定和(he)(he)實施有(you)關生(sheng)(sheng)(sheng)態(tai)保護(hu)和(he)(he)恢復治理方(fang)(fang)(fang)(fang)案(an),個別地(di)(di)區(qu)(qu)(qu)生(sheng)(sheng)(sheng)態(tai)遭(zao)到破壞、局部(bu)(bu)區(qu)(qu)(qu)域生(sheng)(sheng)(sheng)態(tai)退(tui)化(hua)(hua)。第二輪中(zhong)(zhong)央生(sheng)(sheng)(sheng)態(tai)環保督察公布的生(sheng)(sheng)(sheng)態(tai)破壞典型案(an)例中(zhong)(zhong),近半(ban)數與礦山(shan)違(wei)法違(wei)規開采有(you)關。不少地(di)(di)方(fang)(fang)(fang)(fang)反映(ying),歷史遺留(liu)的尾礦庫閉庫治理和(he)(he)生(sheng)(sheng)(sheng)態(tai)修復工作滯后,環境風(feng)險較(jiao)高。生(sheng)(sheng)(sheng)態(tai)系統質量和(he)(he)穩定性有(you)待提升。我國沙化(hua)(hua)土地(di)(di)面積達1.7億公頃,還(huan)有(you)140多萬平方(fang)(fang)(fang)(fang)公里水土流(liu)失(shi)面積亟需(xu)治理,草(cao)原中(zhong)(zhong)度和(he)(he)重度退(tui)化(hua)(hua)面積占1/3以上(shang),部(bu)(bu)分(fen)地(di)(di)區(qu)(qu)(qu)草(cao)原生(sheng)(sheng)(sheng)物災(zai)害較(jiao)為突出(chu)。不少地(di)(di)方(fang)(fang)(fang)(fang)反映(ying),生(sheng)(sheng)(sheng)態(tai)保護(hu)補償機制不健全,科學化(hua)(hua)、規范(fan)化(hua)(hua)有(you)待進一步(bu)加(jia)(jia)(jia)強,市(shi)場化(hua)(hua)補償機制需(xu)加(jia)(jia)(jia)快推進。

(五)生態環保執法監(jian)管有待強(qiang)化

檢查發現,有的基(ji)層(ceng)執法部(bu)門動真碰硬(ying)不(bu)(bu)夠,對存(cun)在的環境問(wen)題查處不(bu)(bu)到位,一定程(cheng)度上存(cun)在“該(gai)硬(ying)不(bu)(bu)硬(ying)、該(gai)嚴不(bu)(bu)嚴、該(gai)重不(bu)(bu)重”等問(wen)題,對篡改(gai)偽造監測數(shu)據、環評弄虛(xu)作假、危險廢物跨省轉移、私設暗管偷排等嚴重違法犯罪(zui)行(xing)為(wei)的執法查處力(li)(li)(li)度還(huan)需(xu)進一步加大。地方(fang)普(pu)遍反映(ying),生(sheng)態(tai)環保機構(gou)執法垂直管理(li)改(gai)革(ge)后(hou),縣級(ji)生(sheng)態(tai)環境主管部(bu)門調整為(wei)市局派出(chu)分局,不(bu)(bu)再(zai)作為(wei)縣級(ji)政(zheng)府組成部(bu)門,執法效能不(bu)(bu)足。基(ji)層(ceng)執法力(li)(li)(li)量(liang)和(he)經費保障不(bu)(bu)夠等問(wen)題較為(wei)普(pu)遍,執法隊伍能力(li)(li)(li)建(jian)設與監管實際需(xu)求(qiu)矛盾(dun)突(tu)出(chu),難以(yi)滿足工作需(xu)要(yao)。

生態(tai)環(huan)境(jing)執法(fa)(fa)(fa)協調(diao)聯動還(huan)有不(bu)足。評(ping)估發現,生態(tai)環(huan)境(jing)綜(zong)合執法(fa)(fa)(fa)改革(ge)涉及15部(bu)法(fa)(fa)(fa)律(lv)(lv)、22件行(xing)(xing)政(zheng)法(fa)(fa)(fa)規、33件部(bu)門規章,共計248項(xiang)行(xing)(xing)政(zheng)執法(fa)(fa)(fa)事(shi)項(xiang),部(bu)門間(jian)職權劃分不(bu)夠(gou)清晰,有規定重復且不(bu)一致的(de)(de)情況。行(xing)(xing)政(zheng)執法(fa)(fa)(fa)和刑(xing)事(shi)司法(fa)(fa)(fa)銜(xian)(xian)接有待(dai)進一步(bu)加強。有的(de)(de)地方反映,行(xing)(xing)政(zheng)部(bu)門、法(fa)(fa)(fa)院(yuan)、檢察、公安協同(tong)配合不(bu)足,對(dui)相關法(fa)(fa)(fa)律(lv)(lv)法(fa)(fa)(fa)規的(de)(de)理解和認定標(biao)準不(bu)統一,存在有案(an)不(bu)移、有案(an)難(nan)移、以罰(fa)代刑(xing)等現象,一些涉嫌犯(fan)罪的(de)(de)案(an)件止步(bu)于行(xing)(xing)政(zheng)執法(fa)(fa)(fa)環(huan)節。刑(xing)事(shi)司法(fa)(fa)(fa)和環(huan)境(jing)損害賠償銜(xian)(xian)接不(bu)夠(gou),司法(fa)(fa)(fa)機(ji)關辦案(an)費用難(nan)以追償。

(六)生態環保法(fa)治體系有待進一步完善

環(huan)(huan)境保護(hu)(hu)法(fa)修訂實施已經8年(nian),部(bu)分(fen)規(gui)定難以適應(ying)新(xin)時(shi)代生(sheng)(sheng)態(tai)文明法(fa)治建設的(de)新(xin)任務新(xin)要求,需(xu)要與時(shi)俱進加以完善。自然生(sheng)(sheng)態(tai)保護(hu)(hu)和修復(fu)法(fa)律制(zhi)度有(you)待(dai)完善,區域生(sheng)(sheng)態(tai)環(huan)(huan)境立法(fa)有(you)待(dai)加強。生(sheng)(sheng)態(tai)環(huan)(huan)境監(jian)測條(tiao)(tiao)例、生(sheng)(sheng)態(tai)保護(hu)(hu)補償條(tiao)(tiao)例亟待(dai)出臺,新(xin)污(wu)染(ran)物治理(li)缺乏相應(ying)標準。地方(fang)(fang)反映,河湖總(zong)磷管(guan)理(li)銜接(jie)不夠,難以滿足治理(li)需(xu)要。碳排(pai)放(fang)、環(huan)(huan)評等領域第(di)三方(fang)(fang)機構(gou)弄虛作(zuo)假犯罪(zui)“入刑”標準還需(xu)進一步(bu)明確。檢查發現,部(bu)分(fen)地方(fang)(fang)法(fa)規(gui)與上位法(fa)銜接(jie)不夠,不少地方(fang)(fang)環(huan)(huan)境保護(hu)(hu)條(tiao)(tiao)例及水、土(tu)壤、固(gu)體廢物污(wu)染(ran)防治條(tiao)(tiao)例尚未制(zhi)定或沒有(you)及時(shi)修改,個別地方(fang)(fang)政府規(gui)章存在“放(fang)水”行為。一些地方(fang)(fang)普法(fa)宣傳(chuan)的(de)廣度和深度不夠,公眾參與和監(jian)督作(zuo)用尚未充分(fen)發揮。

執(zhi)法(fa)(fa)(fa)檢查組經過(guo)認真(zhen)研究認為,造成這些(xie)問題(ti)的主要原因有(you)(you)(you):一是(shi)有(you)(you)(you)些(xie)地(di)(di)方(fang)(fang)對(dui)生(sheng)態(tai)優先、綠色(se)發展理念(nian)理解不(bu)(bu)透,協同推進(jin)經濟高質量(liang)發展和生(sheng)態(tai)環(huan)(huan)(huan)境(jing)高水平保(bao)(bao)護的內生(sheng)動力(li)不(bu)(bu)強(qiang)。在污染防治攻堅戰取得一定成效后,面(mian)對(dui)經濟下(xia)行(xing)壓力(li)增大的形勢,部分地(di)(di)區對(dui)生(sheng)態(tai)環(huan)(huan)(huan)保(bao)(bao)的重(zhong)(zhong)視程度有(you)(you)(you)所(suo)減(jian)(jian)弱(ruo)、保(bao)(bao)護意愿(yuan)有(you)(you)(you)所(suo)下(xia)降、行(xing)動要求有(you)(you)(you)所(suo)放松、投(tou)入力(li)度有(you)(you)(you)所(suo)減(jian)(jian)小。二(er)是(shi)生(sheng)態(tai)環(huan)(huan)(huan)境(jing)保(bao)(bao)護法(fa)(fa)(fa)治意識需(xu)進(jin)一步提高。一些(xie)部門和地(di)(di)方(fang)(fang)不(bu)(bu)知(zhi)法(fa)(fa)(fa)、不(bu)(bu)守法(fa)(fa)(fa)、不(bu)(bu)依法(fa)(fa)(fa)的問題(ti)依然(ran)存在,對(dui)貫徹實施環(huan)(huan)(huan)境(jing)保(bao)(bao)護法(fa)(fa)(fa)的重(zhong)(zhong)要性(xing)(xing)認識不(bu)(bu)足,對(dui)法(fa)(fa)(fa)律職責定位不(bu)(bu)夠清楚,對(dui)法(fa)(fa)(fa)律制(zhi)度學(xue)習掌握不(bu)(bu)夠全面(mian),依法(fa)(fa)(fa)辦事自(zi)覺性(xing)(xing)不(bu)(bu)強(qiang),運(yun)用法(fa)(fa)(fa)律解決問題(ti)的辦法(fa)(fa)(fa)不(bu)(bu)多。三(san)是(shi)生(sheng)態(tai)環(huan)(huan)(huan)境(jing)結(jie)構性(xing)(xing)矛(mao)盾仍然(ran)突出。我國處于工業化(hua)(hua)、城鎮化(hua)(hua)深(shen)入發展階段,能源結(jie)構尚未根本改變(bian),重(zhong)(zhong)化(hua)(hua)工、鋼鐵、煤炭、水泥等(deng)傳統產(chan)業所(suo)占比重(zhong)(zhong)依然(ran)較高,生(sheng)態(tai)環(huan)(huan)(huan)境(jing)保(bao)(bao)護結(jie)構性(xing)(xing)壓力(li)較大,推動形成綠色(se)低(di)碳生(sheng)產(chan)生(sheng)活方(fang)(fang)式(shi)任重(zhong)(zhong)道遠。

四、意見和建議

保(bao)護環境(jing)是基(ji)本(ben)國策。環境(jing)保(bao)護法(fa)是生(sheng)態環保(bao)領域起統領作用的(de)基(ji)礎性、綜合性法(fa)律,確立了(le)生(sheng)態文明建設必須遵循(xun)的(de)基(ji)本(ben)理念(nian)、基(ji)本(ben)原則、基(ji)本(ben)制度,要全面有效實施環境(jing)保(bao)護法(fa),在法(fa)治軌道上保(bao)護生(sheng)態環境(jing),推動綠(lv)色低碳(tan)發(fa)展,建設人與自然和諧共生(sheng)的(de)現代化(hua)。

(一)深入學習貫徹(che)習近平生態文明思(si)想,扎實推進綠色(se)低(di)碳發展

要(yao)堅持把習近(jin)平(ping)生(sheng)(sheng)(sheng)態文(wen)(wen)明思想(xiang)作為貫徹實(shi)施(shi)(shi)環(huan)境(jing)(jing)保護(hu)(hu)法(fa)的根(gen)本遵循(xun),全面有(you)效(xiao)貫徹落(luo)實(shi)生(sheng)(sheng)(sheng)態環(huan)境(jing)(jing)保護(hu)(hu)法(fa)律(lv)制度,以法(fa)治(zhi)思維(wei)、法(fa)治(zhi)方(fang)式推動(dong)和保障習近(jin)平(ping)生(sheng)(sheng)(sheng)態文(wen)(wen)明思想(xiang)貫徹落(luo)實(shi)。要(yao)完整、準確、全面貫徹新(xin)發展理念,牢固樹立綠水(shui)青山(shan)就是金山(shan)銀山(shan)的發展理念,把經(jing)濟(ji)社會發展與環(huan)境(jing)(jing)保護(hu)(hu)相(xiang)協調作為貫徹實(shi)施(shi)(shi)環(huan)境(jing)(jing)保護(hu)(hu)法(fa)律(lv)的重(zhong)要(yao)原(yuan)則(ze),將生(sheng)(sheng)(sheng)態環(huan)境(jing)(jing)保護(hu)(hu)融(rong)入經(jing)濟(ji)社會發展全局,強化環(huan)境(jing)(jing)保護(hu)(hu)規(gui)劃(hua)同各(ge)類發展規(gui)劃(hua)相(xiang)銜接,加快形成綠色發展方(fang)式和生(sheng)(sheng)(sheng)活方(fang)式。要(yao)始(shi)終保持加強生(sheng)(sheng)(sheng)態文(wen)(wen)明建(jian)設戰略(lve)定力(li),認真落(luo)實(shi)法(fa)律(lv)各(ge)項(xiang)規(gui)定,建(jian)立科學合理的考核評價體系,嚴(yan)格考核問責,加快完善生(sheng)(sheng)(sheng)態環(huan)境(jing)(jing)保護(hu)(hu)規(gui)劃(hua)體系,加大財政投(tou)入力(li)度,以生(sheng)(sheng)(sheng)態環(huan)境(jing)(jing)高(gao)水(shui)平(ping)保護(hu)(hu)推動(dong)經(jing)濟(ji)高(gao)質量發展。

(二)堅持以人民為中心,持續改善生態環境(jing)質量

要始終(zhong)堅(jian)持以人(ren)(ren)民(min)為(wei)中心(xin)(xin)的(de)發展思想,認(ren)真貫徹(che)落實環境保(bao)(bao)(bao)護(hu)(hu)法(fa)(fa)(fa)和(he)(he)(he)大氣、水、土壤、固廢、海(hai)洋等生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)(tai)(tai)(tai)環境保(bao)(bao)(bao)護(hu)(hu)法(fa)(fa)(fa)律(lv)法(fa)(fa)(fa)規(gui),堅(jian)持科(ke)學治(zhi)(zhi)(zhi)(zhi)污(wu)、精(jing)準治(zhi)(zhi)(zhi)(zhi)污(wu)、依(yi)法(fa)(fa)(fa)治(zhi)(zhi)(zhi)(zhi)污(wu),以改善(shan)生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)(tai)(tai)(tai)環境質(zhi)量為(wei)核心(xin)(xin),深入打(da)好污(wu)染防治(zhi)(zhi)(zhi)(zhi)攻堅(jian)戰,依(yi)法(fa)(fa)(fa)解決群眾(zhong)身邊(bian)的(de)突出(chu)生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)(tai)(tai)(tai)環境問題(ti),不斷改善(shan)人(ren)(ren)民(min)群眾(zhong)生(sheng)(sheng)(sheng)(sheng)產生(sheng)(sheng)(sheng)(sheng)活環境,保(bao)(bao)(bao)障(zhang)人(ren)(ren)民(min)群眾(zhong)身體健康和(he)(he)(he)生(sheng)(sheng)(sheng)(sheng)命(ming)安全(quan)。要嚴(yan)格(ge)落實法(fa)(fa)(fa)律(lv)規(gui)定的(de)各項生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)(tai)(tai)(tai)保(bao)(bao)(bao)護(hu)(hu)和(he)(he)(he)修(xiu)復制(zhi)(zhi)(zhi)度(du)措施,把(ba)生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)(tai)(tai)(tai)保(bao)(bao)(bao)護(hu)(hu)和(he)(he)(he)修(xiu)復擺(bai)在突出(chu)位置(zhi),堅(jian)持綜(zong)合治(zhi)(zhi)(zhi)(zhi)理、系(xi)統(tong)治(zhi)(zhi)(zhi)(zhi)理、源(yuan)頭治(zhi)(zhi)(zhi)(zhi)理,探索(suo)推(tui)進多(duo)方參與(yu)、分工協(xie)作(zuo)的(de)生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)(tai)(tai)(tai)修(xiu)復工作(zuo)機制(zhi)(zhi)(zhi),統(tong)籌推(tui)進山水林(lin)田(tian)湖(hu)草沙一體化保(bao)(bao)(bao)護(hu)(hu)和(he)(he)(he)修(xiu)復,不斷提升(sheng)生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)(tai)(tai)(tai)系(xi)統(tong)質(zhi)量和(he)(he)(he)穩定性,為(wei)人(ren)(ren)民(min)群眾(zhong)提供更(geng)多(duo)優質(zhi)生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)(tai)(tai)(tai)產品。嚴(yan)格(ge)落實生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)(tai)(tai)(tai)保(bao)(bao)(bao)護(hu)(hu)紅線監(jian)管制(zhi)(zhi)(zhi)度(du),強(qiang)化生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)(tai)(tai)(tai)保(bao)(bao)(bao)護(hu)(hu)執法(fa)(fa)(fa)監(jian)管,依(yi)法(fa)(fa)(fa)加大對(dui)生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)(tai)(tai)(tai)破壞(huai)問題(ti)的(de)監(jian)督和(he)(he)(he)查處力(li)度(du),確保(bao)(bao)(bao)“生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)(tai)(tai)(tai)功能不降低、面積不減(jian)少、性質(zhi)不改變”,筑牢生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)(tai)(tai)(tai)安全(quan)屏障(zhang)。國務院有(you)關部門要加強(qiang)協(xie)調,加快(kuai)建立環境與(yu)健康監(jian)測、調查和(he)(he)(he)風險評估制(zhi)(zhi)(zhi)度(du)。嚴(yan)格(ge)落實法(fa)(fa)(fa)律(lv)關于信息(xi)公(gong)開和(he)(he)(he)公(gong)眾(zhong)參與(yu)的(de)相關制(zhi)(zhi)(zhi)度(du),不斷完(wan)善(shan)公(gong)眾(zhong)監(jian)督舉報反饋機制(zhi)(zhi)(zhi)和(he)(he)(he)獎勵機制(zhi)(zhi)(zhi),有(you)效保(bao)(bao)(bao)障(zhang)公(gong)眾(zhong)的(de)知情權(quan)、參與(yu)權(quan)和(he)(he)(he)監(jian)督權(quan)。

(三)嚴格落(luo)實(shi)法定職責,推動法律制度有效實(shi)施(shi)

ng)違法犯(fan)罪行(xing)為,突出(chu)重(zhong)點(dian)行(xing)業、重(zhong)點(dian)領域(yu)(yu)(yu)(yu)污(wu)(wu)(wu)(wu)(wu)(wu)(wu)(wu)染(ran)(ran)治(zhi)(zhi)理(li),嚴格(ge)畜(chu)禽規模(mo)養殖(zhi)執法監管(guan)(guan),加(jia)(jia)強(qiang)對工業園區(qu)(qu)(qu)生(sheng)(sheng)態(tai)環(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)綜(zong)合(he)整(zheng)治(zhi)(zhi),加(jia)(jia)大公(gong)益訴訟力度(du)(du),著力提(ti)(ti)升企業依法保護環(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)意(yi)識,切實(shi)承擔治(zhi)(zhi)污(wu)(wu)(wu)(wu)(wu)(wu)(wu)(wu)主體(ti)(ti)責(ze)任(ren),堅決防止(zhi)出(chu)現“企業得利、群(qun)眾受(shou)害、政府買單(dan)”現象。

(四)健全完善生(sheng)(sheng)態環保法律體(ti)(ti)系,用最嚴格制度最嚴密法治保護生(sheng)(sheng)態環境

完(wan)善(shan)生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)(tai)環保(bao)法(fa)(fa)律法(fa)(fa)規。適(shi)時修(xiu)改(gai)環境(jing)(jing)保(bao)護法(fa)(fa),增加(jia)減(jian)污(wu)(wu)降碳協同增效(xiao)、綠色低碳發(fa)展相關內容;健全環保(bao)管理(li)體制(zhi),將“黨政同責(ze)(ze)、一崗雙責(ze)(ze)”責(ze)(ze)任制(zhi)等生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)(tai)文(wen)明體制(zhi)改(gai)革成果轉化為法(fa)(fa)律制(zhi)度;結(jie)合省以(yi)下(xia)環保(bao)機構(gou)監測(ce)監察執(zhi)法(fa)(fa)垂直管理(li)制(zhi)度改(gai)革,賦予縣(xian)級生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)(tai)環境(jing)(jing)分(fen)局獨立的執(zhi)法(fa)(fa)主(zhu)體資格,明確鄉鎮(街道(dao))人(ren)民政府(fu)、產(chan)業(ye)園區管理(li)機構(gou)的環保(bao)職責(ze)(ze);完(wan)善(shan)生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)(tai)保(bao)護紅線監管制(zhi)度、生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)(tai)環境(jing)(jing)損害賠償制(zhi)度,增加(jia)光(guang)污(wu)(wu)染防治相關措施等。適(shi)時制(zhi)定或修(xiu)改(gai)國家公園法(fa)(fa)、自然保(bao)護地(di)法(fa)(fa)、礦產(chan)資源法(fa)(fa)等法(fa)(fa)律。加(jia)快(kuai)出(chu)臺生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)(tai)環境(jing)(jing)監測(ce)條例、生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)(tai)保(bao)護補(bu)償條例等配(pei)套法(fa)(fa)規,健全生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)(tai)監管標準體系,完(wan)善(shan)生(sheng)(sheng)(sheng)(sheng)態(tai)(tai)(tai)保(bao)護紅線管理(li)制(zhi)度,建立環境(jing)(jing)資源案件鑒(jian)定評估費用(yong)追償制(zhi)度,細化第三(san)方環保(bao)服(fu)務機構(gou)弄虛作假(jia)犯罪“入刑”規定,在(zai)重要水源保(bao)護區和流(liu)域(yu)制(zhi)定限制(zhi)性農(nong)業(ye)生(sheng)(sheng)(sheng)(sheng)產(chan)技(ji)術標準等。

完善(shan)地方(fang)法(fa)規(gui)(gui)標(biao)準(zhun)體(ti)系。各(ge)地要結合實際,抓緊制(zhi)修訂(ding)生(sheng)態環保領域地方(fang)性法(fa)規(gui)(gui)。鼓勵和(he)(he)支持地方(fang)開(kai)(kai)展(zhan)區(qu)域性流(liu)域性生(sheng)態環保立法(fa),注重(zhong)通過“小(xiao)快靈”立法(fa)增強地方(fang)性法(fa)規(gui)(gui)的(de)針對性和(he)(he)可操作性。根(gen)據(ju)行(xing)業(ye)整治要求(qiu)和(he)(he)環境(jing)質量改善(shan)要求(qiu),針對特(te)色聚集產業(ye)出臺(tai)更(geng)加(jia)嚴(yan)格的(de)地方(fang)標(biao)準(zhun)。各(ge)地各(ge)部門要依(yi)法(fa)定期開(kai)(kai)展(zhan)生(sheng)態環保相(xiang)關法(fa)規(gui)(gui)規(gui)(gui)章清(qing)理工(gong)作。

(五(wu))依(yi)法提(ti)高生態環(huan)境治理體(ti)(ti)系(xi)和(he)治理能力現代化水平

完善以排污(wu)許可(ke)制(zhi)(zhi)(zhi)(zhi)為核心的固定(ding)污(wu)染源監管制(zhi)(zhi)(zhi)(zhi)度(du)(du)(du)體系(xi),優化排污(wu)許可(ke)證內容,加強環(huan)境(jing)(jing)影響評價制(zhi)(zhi)(zhi)(zhi)度(du)(du)(du)和(he)排污(wu)許可(ke)制(zhi)(zhi)(zhi)(zhi)度(du)(du)(du)融合銜(xian)接(jie)。落實環(huan)境(jing)(jing)監測(ce)(ce)制(zhi)(zhi)(zhi)(zhi)度(du)(du)(du),建(jian)立(li)(li)健全(quan)基于現(xian)代感(gan)知技術和(he)大(da)數據(ju)技術的生(sheng)(sheng)態環(huan)境(jing)(jing)監測(ce)(ce)網(wang)絡,優化監測(ce)(ce)站網(wang)布局,實現(xian)環(huan)境(jing)(jing)質量、生(sheng)(sheng)態質量、污(wu)染源監測(ce)(ce)全(quan)覆蓋。健全(quan)生(sheng)(sheng)態環(huan)境(jing)(jing)監測(ce)(ce)質量管理體系(xi),建(jian)立(li)(li)暢通高效的監測(ce)(ce)數據(ju)共(gong)享(xiang)機(ji)制(zhi)(zhi)(zhi)(zhi),確(que)保(bao)(bao)監測(ce)(ce)數據(ju)真實、準確(que)、全(quan)面。落實生(sheng)(sheng)態保(bao)(bao)護(hu)補償制(zhi)(zhi)(zhi)(zhi)度(du)(du)(du),建(jian)立(li)(li)健全(quan)森林、草原、濕地等領(ling)域(yu)(yu)生(sheng)(sheng)態保(bao)(bao)護(hu)補償制(zhi)(zhi)(zhi)(zhi)度(du)(du)(du),不斷完善市場化多元化生(sheng)(sheng)態保(bao)(bao)護(hu)補償機(ji)制(zhi)(zhi)(zhi)(zhi)。完善綠(lv)色低碳發展相關的財政、稅(shui)收(shou)、價格(ge)、采購等政策,擴(kuo)大(da)環(huan)境(jing)(jing)保(bao)(bao)護(hu)、節能節水(shui)等企業所得稅(shui)優惠(hui)目錄(lu)范(fan)圍(wei),引導和(he)鼓勵更多社(she)會資本投(tou)入生(sheng)(sheng)態環(huan)境(jing)(jing)領(ling)域(yu)(yu),構建(jian)多元化生(sheng)(sheng)態環(huan)保(bao)(bao)投(tou)入機(ji)制(zhi)(zhi)(zhi)(zhi)。按照污(wu)染者(zhe)付費原則,科學合理制(zhi)(zhi)(zhi)(zhi)定(ding)污(wu)水(shui)垃圾處理收(shou)費標準,依(yi)法加大(da)征(zheng)收(shou)力度(du)(du)(du)。

深化運用生態環(huan)境綜合(he)行政執法(fa)和垂直管理(li)(li)改革成(cheng)果,加(jia)強基層(ceng)執法(fa)隊(dui)伍建(jian)設,強化基層(ceng)環(huan)保執法(fa)機(ji)(ji)構職能(neng),推動機(ji)(ji)構規(gui)范化、裝備現代化、隊(dui)伍專(zhuan)業(ye)化、管理(li)(li)制度(du)化,不斷優化執法(fa)方(fang)式,提高執法(fa)效能(neng)。推進(jin)環(huan)境行政執法(fa)與(yu)刑事司法(fa)有效銜接,落(luo)實(shi)生態環(huan)境主管部門與(yu)公安(an)機(ji)(ji)關、檢察(cha)機(ji)(ji)關、審判機(ji)(ji)關信息共(gong)享、案(an)情通報、案(an)件移(yi)送制度(du),在證據認證保全、工作協助等方(fang)面加(jia)強配(pei)合(he),統(tong)籌解決涉案(an)物品歸口處(chu)置和檢驗鑒定等問題。

強化科技(ji)支(zhi)撐,把生(sheng)(sheng)態(tai)環(huan)(huan)境(jing)保(bao)護(hu)技(ji)術研發(fa)擺在國家中長期科技(ji)發(fa)展(zhan)規(gui)劃的(de)重要位(wei)置,全面(mian)(mian)提升生(sheng)(sheng)態(tai)環(huan)(huan)境(jing)領域科研能(neng)力、技(ji)術開(kai)發(fa)能(neng)力和決策(ce)支(zhi)持(chi)能(neng)力,構(gou)建(jian)智慧高(gao)效的(de)生(sheng)(sheng)態(tai)環(huan)(huan)境(jing)管理(li)信息化體系(xi)。加快(kuai)綠色(se)低碳技(ji)術研發(fa)應用(yong),推進各類污染防治、清潔生(sheng)(sheng)產、生(sheng)(sheng)態(tai)修復、資源再生(sheng)(sheng)等方面(mian)(mian)的(de)經濟適用(yong)技(ji)術研究(jiu),加強生(sheng)(sheng)態(tai)環(huan)(huan)境(jing)科技(ji)成果(guo)轉化應用(yong)。

(六(liu))深入(ru)開展(zhan)法律宣傳教(jiao)育,增(zeng)強全社(she)會依法保護(hu)生(sheng)態環境意識(shi)

各(ge)地各(ge)部門要(yao)切(qie)實承擔起宣傳普(pu)及法(fa)律責任,帶(dai)頭(tou)尊法(fa)學(xue)法(fa)守法(fa)用法(fa),提(ti)高依(yi)法(fa)行(xing)政(zheng)的能力和水平,用法(fa)律武器(qi)破解生態環(huan)境(jing)保護的難點(dian)(dian)堵點(dian)(dian)問題,在法(fa)治(zhi)軌道上深入打(da)好污(wu)染(ran)防治(zhi)攻堅戰。法(fa)律宣傳要(yao)從城市向農村延伸,更加突出一線執(zhi)法(fa)人(ren)(ren)員、企業負(fu)責人(ren)(ren)等重點(dian)(dian)人(ren)(ren)群。通過宣傳教育,引導企業、組織、公民增強環(huan)境(jing)意識、行(xing)使環(huan)境(jing)權利、自覺履行(xing)環(huan)保法(fa)律義務,積極踐行(xing)簡約適度、綠色低碳生活方式,把建設(she)美麗(li)中國轉化為每一個(ge)人(ren)(ren)的自覺行(xing)動。
